1 AN ACT
2 RELATING TO THE STATE BOARD OF CORRECTION; AMENDING SECTION 20-214, IDAHO
3 CODE, TO DELETE A REFERENCE TO GUARDS, TO PROVIDE THE STATE BOARD OF COR-
4 RECTION WITH POWER AND AUTHORITY TO SPECIFY THE TRAINING OF CERTAIN PER-
5 SONS AND TO MAKE A REFERENCE TO THE DEPARTMENT OF CORRECTION.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 20-214, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 20-214. ASSISTANTS, AND OFFICERS. AND GUARDS. The state board of correc-
10 tion shall have power and authority to employ, to specify the training, and
11 to fix the duties of such assistants, officers, guards and other persons nec-
12 essary for the proper and efficient administration of the state penitentiary
13 department of correction and the property used in connection therewith, for
14 the administration of the parole and probation system, and generally for the
15 carrying out of the provisions of this act, subject to the provisions of chap-
16 ter 53, title 67, Idaho Code.
STATEMENT OF PURPOSE
RS 10546
The purpose of the language changes to Statute 20-214 are to
provide the state board of correction with the power and
authority to specify the training of IDOC employees. POST
will be submitting a proposed amendment to Statute 19-5109,
as follows: The council may implement such minimum basic
training and certification standards for department of
correction assistants and officers as the board of correction
may specify.
The proposed changes will have an impact on state funds when
POST takes over pre-service and specialty training for IDOC.
Because POST is in the process of developing their budget and
hasn't completed their assessment of costs related to taking
over IDOC training, it is difficult to ascertain what the
fiscal impact will be.
