2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING CHAPTER 4, TITLE
3 49, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 49-420G, IDAHO CODE, TO
4 ESTABLISH AN IDAHO BOY SCOUT LICENSE PLATE PROGRAM; AMENDING SECTION
5 49-402, IDAHO CODE, TO PROVIDE CORRECT REFERENCES AND TO PROVIDE A REFER-
6 ENCE TO FEES FOR THE IDAHO BOY SCOUT LICENSE PLATE; AND PROVIDING AN
7 EFFECTIVE DATE.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Chapter 4, Title 49, Idaho Code, be, and the same is
10 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
11 ignated as Section 49-420G, Idaho Code, and to read as follows:
12 49-420G. IDAHO BOY SCOUT PLATES. (1) On and after January 1, 2004, any
13 person who is the owner of a vehicle registered under the provisions of sec-
14 tion 49-402, Idaho Code, or registered under any other section of law for
15 which the purchase of special plates is allowed, may apply for, and upon
16 department approval, receive special Idaho boy scout license plates in lieu of
17 regular license plates. The provisions of this section shall not apply to any
18 vehicle with a registered maximum gross weight over twenty-six thousand
19 (26,000) pounds. Availability of Idaho boy scout plates for other vehicles
20 shall be subject to the rules, policies and procedures of the department.
21 (2) In addition to the regular registration fee required in chapter 4,
22 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol-
23 lars ($35.00) for the initial issuance of plates and twenty-five dollars
24 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the
25 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in
26 the state highway account and shall be used to fund the cost of administration
27 of this special license plate program. Twenty-five dollars ($25.00) of each
28 initial fee and fifteen dollars ($15.00) of each renewal fee shall be depos-
29 ited by the department to the respective boy scout council in which the sell-
30 ing county is located. Inland Northwest Council, Boy Scouts of America, con-
31 tains the following counties: Benewah, Bonner, Boundary, Clearwater, Idaho,
32 Kootenai, Latah, Lewis, Nez Perce and Shoshone. Ore-Ida Council, Boy Scouts of
33 America, contains the following counties: Ada, Adams, Boise, Canyon, Elmore,
34 Gem, Owyhee, Payette, Valley and Washington. Snake River Council, Boy Scouts
35 of America, contains the following counties: Blaine, Camas, Cassia, Custer,
36 Gooding, Jerome, Lincoln, Minidoka and Twin Falls. Grand Teton Council, Boys
37 Scouts of America, contains the following counties: Bannock, Bear Lake, Bing-
38 ham, Bonneville, Butte, Caribou, Clark, Franklin, Fremont, Jefferson, Lemhi,
39 Madison, Oneida, Power and Teton. Boy scout councils whose borders extend out-
40 side the state of Idaho are restricted to utilization of received funds
41 totally within the state of Idaho.
42 (3) Whenever title or interest in a vehicle registered under the provi-
43 sions of this section is transferred or assigned, the owner may transfer the

1 special plates to another vehicle upon payment of the required transfer fees.
2 The owner may only display the plates on another vehicle upon receipt of the
3 new registration from the department.
4 (4) The Idaho boy scout license plate shall be of a color and design in
5 accordance with the provisions of section 49-402C, Idaho Code. That portion of
6 the design which features the Idaho boy scout program shall be acceptable to
7 the Boy Scouts of America. The design shall be approved by the department,
8 utilizing a numbering system as determined by the department. Initial costs of
9 the plate program, including the costs of plate design shall be paid by the
10 Boy Scouts of America.
11 (5) Sample boy scout license plates may be purchased for a fee of thirty
12 dollars ($30.00), ten dollars ($10.00) of which shall be deposited in the
13 state highway account and twenty dollars ($20.00) of which shall be deposited
14 by the department to the respective boy scout council in which the selling
15 county is located as provided in subsection (2) of this section. Boy scout
16 councils whose boundaries extend outside the state of Idaho are restricted to
17 utilization of received funds totally within the state of Idaho. No additional
18 fee shall be charged for personalizing sample plates.
19 SECTION 2. That Section 49-402, Idaho Code, be, and the same is hereby
20 amended to read as follows:
21 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup
22 truck and each other motor vehicle having a maximum gross weight not in excess
23 of eight thousand (8,000) pounds shall be:
24 Vehicles one (1) and two (2) years old ............................ $48.00
25 Vehicles three (3) and four (4) years old ......................... $36.00
26 Vehicles five (5) and six (6) years old ........................... $36.00
27 Vehicles seven (7) and eight (8) years old ........................ $24.00
28 Vehicles over eight (8) years old ................................. $24.00
29 There shall be twelve (12) registration periods, starting in January for
30 holders of validation registration stickers numbered 1, and proceeding consec-
31 utively through December for holders of validation registration stickers num-
32 bered 12, each of which shall start on the first day of a calendar month and
33 end on the last day of the twelfth month from the first day of the beginning
34 month. Registration periods shall expire midnight on the last day of the reg-
35 istration period in the year designated by the validation registration
36 sticker. The numeral digit on the validation registration stickers shall, as
37 does the registration card, fix the registration period under the staggered
38 plate system of Idaho for the purpose of reregistration and notice of expira-
39 tion.
40 A vehicle that has once been registered for any of the above designated
41 periods shall, upon reregistration, be registered for the period bearing the
42 same number, and the registration card shall show and be the exclusive proof
43 of the expiration date of registration and licensing. Vehicles may be ini-
44 tially registered for less than a twelve (12) month period, or for more than a
45 twelve (12) month period, and the fee prorated on a monthly basis if the frac-
46 tional registration tends to fulfill the purpose of the monthly series regis-
47 tration system.
48 (2) For all school buses operated either by a nonprofit, nonpublic school
49 or operated pursuant to a service contract with a school district for trans-
50 porting children to or from school or in connection with school approved
51 activities, the annual fee shall be twenty-four dollars ($24.00).
52 (3) For all motorcycles and all-terrain vehicles operated upon the public
53 highways the annual fee shall be nine dollars ($9.00). For operation of an

1 all-terrain vehicle or motorcycle off the public highways, the fee specified
2 in section 67-7122, Idaho Code, shall be paid. Registration exemptions pro-
3 vided in section 49-426(2) and (3), Idaho Code, apply to all-terrain vehicles
4 and motorcycles used for the purposes described in subsections (2) and (3) of
5 section 49-426, Idaho Code.
6 (4) For all motor homes the fee shall be as specified in subsection (1)
7 of this section and shall be in addition to the fees provided for in section
8 49-445, Idaho Code.
9 (5) Registration fees shall not be subject to refund.
10 (6) A financial institution or repossession service contracted to a
11 financial institution repossessing vehicles under the terms of a security
12 agreement shall move the vehicle from the place of repossession to the finan-
13 cial institution's place of business on a repossession plate. The repossession
14 plate shall also be used for demonstrating the vehicle to a prospective pur-
15 chaser for a period not to exceed ninety-six (96) hours. The registration fees
16 for repossession plates shall be as required in subsection (1) of this section
17 for a vehicle one (1) and two (2) years old. All other fees required under
18 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee.
19 The repossession plate shall be issued on an annual basis by the department.
20 (7) In addition to the annual registration fee in this section, there
21 shall be an initial program fee of twenty-five dollars ($25.00) and an annual
22 program fee of fifteen dollars ($15.00) for all special license plate programs
23 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408,
24 49-409, 49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur-
25 suant to sections 49-406 and 49-406A, Idaho Code, there shall be an initial
26 program fee of twenty-five dollars ($25.00) but there shall be no annual
27 renewal fee. For special plates issued pursuant to sections 49-417, 49-417A,
28 49-417B, 49-417C, 49-418A, 49-418B, 49-418C, 49-419, 49-419A, 49-420, 49-420A,
29 49-420B, and 49-420C, 49-420D, 49-420E and 49-420G, Idaho Code, there shall be
30 an initial program fee of thirty-five dollars ($35.00) and an annual program
31 fee of twenty-five dollars ($25.00). The fees contained in this subsection
32 shall be applicable to all new special plate programs. The initial program fee
33 and the annual program fee shall be deposited in the state highway account and
34 shall be used to fund the cost of administration of special license plate pro-
35 grams, unless otherwise specified by law.
36 SECTION 3. This act shall be in full force and effect on and after Janu-
37 ary 1, 2004.
STATEMENT OF PURPOSE

The purpose of this legislation is to create a special motor
vehicle license plate for Boy Scout youth programs in Idaho.
Consistent with other special license plates, in the first year
those vehicle owners purchasing special plates pay $35 to the
Idaho Transportation Department(ITD). ITD keeps $10 to cover
costs with the remaining $25 being used for the specified
charitable purposes.
In the second year and beyond, license holders pay $25 per annum
with the amount going for charitable purposes being reduced to
$15.
FISCAL IMPACT
ITD is compensated for all of its costs. Therefore, there is no
fiscal impact. There are 34,685 Boy Scouts and 18,642 adult
leaders in four Idaho Boy Scout Councils. It is expected that a
high percentage of the parents of Boy Scouts will purchase these
license plates for their vehicles.
