BY HEALTH AND WELFARE COMMITTEE
1 AN ACT
2 RELATING TO ENFORCEMENT PROCEDURES RELATING TO HEALTH AND SAFETY; AMENDING
3 SECTION 39-1606, IDAHO CODE, TO PROVIDE CORRECT CODE CITATIONS.
4 Be It Enacted by the Legislature of the State of Idaho:
5 SECTION 1. That Section 39-1606, Idaho Code, be, and the same is hereby
6 amended to read as follows:
7 39-1606. CRIMINAL AND CIVIL PROCEEDINGS. The regulatory authority may
8 seek to enforce the provisions of this chapter and any rule or standard
9 adopted by the board pursuant to this chapter through a court of competent
10 jurisdiction.
11 (1) Misdemeanor proceedings may be brought in accordance with sections
12 39-109, 39-117 56-1008, 56-1010, 37-117 and 37-119, Idaho Code.
13 (2) Civil proceedings may be brought in accordance with sections 39-108
14 56-1009 and 39-109 56-1010, Idaho Code.
15 (3) Injunctive relief may be sought in accordance with sections 39-108,
16 39-109 56-1009, 56-1010 and 37-116, Idaho Code.
STATEMENT OF PURPOSE
RS 12320
When those sections of the Idaho Code relating to the Department of
Health and Welfare were separated from those provisions relating to
the Idaho Department of Environmental Quality, the enforcement
provisions of the Food Establishment Act were not adjusted
accordingly. This bill corrects the references to statutory
enforcement provisions in the food establishment act to reflect
current enforcement statutes applicable to the Department of Health
and Welfare.
