2 RELATING TO REAL PROPERTY OWNED BY THE UNIVERSITY OF IDAHO; AMENDING SECTION
3 58-335, IDAHO CODE, TO PROVIDE FOR A PROCESS TO BE FOLLOWED IN THE DIS-
4 POSAL OF REAL PROPERTY BY THE UNIVERSITY OF IDAHO.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 58-335, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 58-335. LANDS EXEMPT FROM ACT. This act shall not be construed as apply-
9 ing to any lands or properties acquired under the act of congress, known as
10 the Idaho Admission Act, or in the subsequent operations of the various endow-
11 ment funds of the state. Nor shall this act apply to any lands or properties
12 in the custody of the board of regents of the University of Idaho in its cor-
13 porate capacity: provided, however, that the board of regents, desiring to
14 avail itself of the facilities of this act, for the sale, exchange or transfer
15 of any such properties, may proceed to negotiate a sale, transfer or exchange
16 with the state board of land commissioners as would any other tax-supported
17 agency. If the board of regents of the University of Idaho does not avail
18 itself of the facilities of this act, the board of regents shall use a process
19 for disposal of real property that includes, at a minimum, a required
20 appraisal and public notice of the proposed real property disposal prior to
21 disposal; and for property disposals that are not part of an exchange or
22 transfer, consideration given to granting a first option to purchase to local,
23 state and federal governmental entities.
STATEMENT OF PURPOSE
RS 14109
Unlike other State Agencies, the University of Idaho has no required
procedures for disposing of surplus property. RS 14109 establishes a
required process for disposal of surplus property that is similar to
that of other state bodies, but still retains control by the Board of
Regents as required under the land grant provisions pertaining to the
University.
FISCAL IMPACT
There is no fiscal impact from this legislation.
