20 Be It Enacted by the Legislature of the State of Idaho:
21 SECTION 1. The state of Idaho is committed to participating as an active
22 partner with affected water users to develop a long-term solution to address
23 the declines in spring flows discharging from the Eastern Snake Plain Aquifer.
24 SECTION 2. In addition to the appropriation made in Section 1, Chapter
25 229, Laws of 2003, there is hereby appropriated to the Department of Commerce
26 the following amount to be expended for the designated program according to
27 the designated expense classes from the listed fund for the period July 1,
28 2003, through June 30, 2004:

36 SECTION 3. In addition to the full-time equivalent positions authorized

40 SECTION 4. In addition to the appropriation made in Section 1, Chapter
41 324, Laws of 2003, there is hereby appropriated to the Department of Water

1 Resources the following amount to be expended for the designated program
2 according to the designated expense classes from the listed fund for the
3 period July 1, 2003, through June 30, 2004:

11 SECTION 5. In addition to the full-time equivalent positions authorized
12 in Section 2, Chapter 324, Laws of 2003, there is hereby authorized one (1)
13 full-time equivalent position for the Department of Water Resources for the
14 period July 1, 2003, through June 30, 2004.
15 SECTION 6. There is hereby appropriated $520,000 from the General Fund
16 for the period July 1, 2003, through June 30, 2004. The State Controller shall
17 immediately transfer that amount to the Water Management Fund established in
18 Section 42-1760, Idaho Code. Such moneys shall be used to rent storage water.
19 SECTION 7. In addition to the appropriation made in Section 1 of Senate
20 Bill No. 1405, as enacted by the Second Regular Session of the Fifty-seventh
21 Idaho Legislature, there is hereby appropriated to the Department of Commerce
22 the following amount to be expended for the designated program according to
23 the designated expense classes from the listed fund for the period July 1,
24 2004, through June 30, 2005:

36 full-time equivalent position for the Department of Commerce for the period
37 July 1, 2004, through June 30, 2005.
38 SECTION 9. In addition to the appropriation made in Section 1 of Senate
39 Bill No. 1415, as enacted by the Second Regular Session of the Fifty-seventh
40 Idaho Legislature, there is hereby appropriated to the Department of Water
41 Resources the following amount to be expended for the designated program
42 according to the designated expense classes from the listed fund for the
43 period July 1, 2004, through June 30, 2005:

1 SECTION 10. In addition to the full-time equivalent positions authorized
2 in Section 2 of Senate Bill No. 1415, as enacted by the Second Regular Session
3 of the Fifty-seventh Idaho Legislature, there is hereby authorized one (1)
4 full-time equivalent position for the Department of Water Resources for the
5 period July 1, 2004, through June 30, 2005.
6 SECTION 11. The Idaho Water Resource Board is authorized to redirect up
7 to $300,000 in encumbered moneys originally appropriated for aquifer recharge
8 in Section 1, Chapter 200, Laws of 1995. The Board shall transfer such moneys
9 to the Miscellaneous Revenue Fund in the Department of Water Resources to be
10 used to develop and implement a long-term aquifer management plan. In addition
11 to the appropriation provided in Section 1 of Senate Bill No. 1415, as enacted
12 by the Second Regular Session of the Fifty-seventh Idaho Legislature, there is
13 hereby appropriated to the Department of Water Resources $300,000 from the
14 Miscellaneous Revenue Fund to be expended for the Planning and Technical Ser-
15 vices Program for the period July 1, 2004, through June 30, 2005.
16 SECTION 12. There is hereby appropriated $500,000 from the General Fund
17 for the period July 1, 2004, through June 30, 2005. The State Controller shall
18 transfer that amount on July 1, 2004, to the Revolving Development Fund estab-
19 lished in Section 42-1752, Idaho Code. Such moneys shall be used for loans to
20 ground water districts.
21 SECTION 13. An emergency existing therefor, which emergency is hereby
22 declared to exist, Sections 1 through 6 of this act shall be in full force and
23 effect on and after passage and approval.

This bill funds the legislative commitment to a stipulated settlement to develop a long-term solution to address the declines in spring flows discharging from the Eastern Snake Plain Aquifer. The bill is composed of two parts. The first part, sections 1 though 6, addresses fiscal year 2004 and includes one additional position for the Department of Commerce and one additional position for the Department of Water Resources for the remaining three months of the current fiscal year. The position in the Department of Commerce will assist water users affected by the decline in flows from springs below the Eastern Snake River Plain. The position in the Department of Water Resources will assist water masters for water districts and will assist with the identification of alternatives to improve the management and use of available spring flows. It also contains the transfer of $520,000 from the General Fund to the Water Management Fund for the Water Board to rent 40,000 acre feet of water on a one-time basis.
The second part, sections 7 through 12, provides full-year funding for the same one position for the Department of Commerce and the same one position for the Department of Water Resources totaling $139,900, ongoing. Then it includes $500,000, one-time, for the Department of Commerce for grants to affected spring users to implement infrastructure improvements. Next, the bill includes $500,000, one-time, to be transferred to the Revolving Development Fund for the Water Board to make loans to the North Snake and Magic Valley ground water districts. These loans are to be used to pay for out of priority diversions. Finally, the bill includes $300,000 in one-time dedicated spending authority to develop and implement a long-term aquifer management plan.

| Fiscal Note |
The total FY 2004 impact is $544,500 to the General Fund. The FY 2005 impact is $1,139,900 from the General Fund and $300,000 from the Miscellaneous Revenue Fund for a total of $1,439,900. The combined FY 2004 and FY 2005 impact is $1,684,400 to the General Fund and $300,000 impact on dedicated funds for a total of $1,984,400. The source of the dedicated funds is from the cancellation of encumbrances made on legislative appropriations authorized for aquifer recharge in 1995. All of the funding is one-time except the $139,900 for the two ongoing positions.
