1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART-
3 MENT OF HEALTH AND WELFARE RELATING TO FOOD SAFETY AND SANITATION STAN-
4 DARDS FOR FOOD ESTABLISHMENTS.
5 Be It Resolved by the Legislature of the State of Idaho:
6 WHEREAS, the Legislature is vested with authority to reject executive
7 agency rules under the provisions of Section 67-5291, Idaho Code, in the event
8 that the Legislature finds that the rules are not consistent with legislative
9 intent; and
10 WHEREAS, it is the finding of the Legislature that certain rules of the
11 Department of Health and Welfare relating to food safety and sanitation stan-
12 dards for food establishments are not consistent with legislative intent and
13 should be rejected.
14 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
15 sion of the Fifty-seventh Idaho Legislature, the House of Representatives and
16 the Senate concurring therein, that IDAPA 16.02.19, rules of the Department of
17 Health and Welfare governing food safety and sanitation standards for food
18 establishments, adopted as pending rules under Docket Number 16-0219-0301, the
19 entire rulemaking docket, and IDAPA 16.02.19, rules of the Department of
20 Health and Welfare relating to food safety and sanitation standards for food
21 establishments, adopted as pending rules under Docket Number 16-0219-0302, the
22 entire rulemaking docket, be, and the same are hereby rejected and declared
23 null, void and of no force and effect.
STATEMENT OF PURPOSE
RS 14184
This concurrent resolution would reject certain pending
administrative rules changes of the Department of Health and
Welfare relating to food safety and sanitation standards for food
establishments. The effect of this resolution, if adopted by
both houses, would be to prevent the agency rules from going into
effect.

This concurrent resolution has no fiscal impact
