2 STATING LEGISLATIVE FINDINGS AND AUTHORIZING THE LEGISLATIVE COUNCIL TO EXPAND
3 THE MEMBERSHIP AND SCOPE OF THE COMMITTEE APPOINTED TO UNDERTAKE AND COM-
4 PLETE A STUDY OF NATURAL RESOURCE ISSUES.
5 Be It Resolved by the Legislature of the State of Idaho:
6 WHEREAS, the First Regular Session of the Fifty-seventh Idaho Legislature
7 adopted Senate Concurrent Resolution No. 103 in 2003, which authorized the
8 Legislative Council to appoint a committee to undertake and complete a study
9 of natural resource issues and to make a report detailing its findings, recom-
10 mendations and proposed legislation to the First Regular Session of the Fifty-
11 eighth Idaho Legislature; and
12 WHEREAS, the committee has been studying water quality, endangered species
13 act activities and reserved water right tribal issues and the Legislature
14 believes that the membership of this committee needs to be expanded and the
15 scope of their investigation and study needs to be broadened as well; and
16 WHEREAS, aquifers in many areas of Idaho continue long-term declines,
17 threatening economic well-being and creating legal conflicts; and
18 WHEREAS, delay in seeking means to bring long-term stability creates unac-
19 ceptable risks to the well-being of our citizens; and
20 WHEREAS, the decline in water supplies of the Eastern Snake Plain Aquifer
21 and the Thousand Springs is causing conflicts between water users; and
22 WHEREAS, on March 15, 2004, water users and the state reached an agreement
23 to suspend pending conflicts and to provide a one-year period for the commit-
24 tee to develop and make recommendations to the First Regular Session of the
25 Fifty-eighth Idaho Legislature for implementation of long-term restoration and
26 recovery solutions for the Eastern Snake Plain Aquifer and the Thousand
27 Springs water supplies; and
28 WHEREAS, it is the desire of the Legislature that the committee study and
29 evaluate ways to stabilize the water distribution system in Idaho and that
30 various interests and people in the water supply arena be allowed to give
31 input and testimony to the committee; and
32 WHEREAS, the Legislature desires that the committee involve persons with
33 technical expertise in hydrology, engineering, economics and law in its delib-
34 eration and at a minimum conduct a study regarding water supply and management
35 issues in the Moscow, Rathdrum Prairie and Snake River Plain Aquifers and the
36 Bear River Drainage.
37 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
38 sion of the Fifty-seventh Idaho Legislature, the House of Representatives and
39 the Senate concurring therein, that the Legislative Council is authorized to
40 expand the membership of the committee which is undertaking and completing a
41 study of natural resource issues and that the cochairmen of the committee are
42 authorized to appoint advisors with technical expertise in the water supply
43 arena and are expected to receive input from stakeholders in the water rights
44 system of Idaho to attempt to stabilize the water delivery system in this

1 state.
2 BE IT FURTHER RESOLVED that any advisors to the committee who are not leg-
3 islative members shall not be reimbursed from legislative funds for per diem,
4 mileage or other expenses and shall not have voting privileges regarding the
5 committee's recommendations and proposed legislation.
6 BE IT FURTHER RESOLVED that the committee will ensure in conjunction with
7 the executive branch that all state commitments set forth in the March 15,
8 2004, agreement between water users and the state of Idaho are fulfilled.
STATEMENT OF PURPOSE

This resolution would authorize the Legislative Council to
continue an interim study committee to undertake and complete a
study of natural resource issues. A number of interrelated major
water and natural resource issues could soon have major impacts
upon the state and its citizens.
FISCAL IMPACT
If this resolution is adopted by the Legislature and the
committee is continued by Legislative Council, any necessary
legislator travel and per diem expense would be paid from the
existing legislative appropriation to the Senate and the House of
Representatives. Funding for staff support and expenses would be
provided from the existing appropriation to the Legislative
Council for the Legislative Services Office. There would be no
additional impact upon the state general fund as a result of this
resolution.
