  1                                        AN ACT
  2    RELATING TO OPERATION OF RAILROADS; AMENDING SECTION 62-412,  IDAHO  CODE,  TO
  3        PROVIDE  REQUIRED  SIGNALING  BY LOCOMOTIVES FOR PRESCRIBED TIMES AND DIS-
  4        TANCES BEFORE CROSSINGS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 62-412, Idaho Code, be, and the  same  is  hereby
  7    amended to read as follows:
                                                                        
  8        62-412.  BELL  OR  WHISTLE  TO  BE SOUNDED. A bell of at least twenty (20)
  9    pounds weight must be placed on each locomotive engine, and be rung at a  dis-
 10    tance  of  at least fifteen (15) seconds but not more than twenty (20) seconds
 11    before the crossing. If the movement of the locomotive engine  exceeds  forty-
 12    five (45) miles per hour, then the bell must be rung eighty (80) rods, approx-
 13    imately  one-quarter (1/4) mile, from the place where the railroad crosses any
 14    public street, road or highway, and be kept ringing until it has crossed  such
 15    public  street,  road  or  highway; or and an adequate steam, air, electric or
 16    other similar whistle must be attached, and be sounded, except in  cities,  at
 17    the  like distance, and be kept sounding at intervals until it has crossed the
 18    same, at least fifteen (15) seconds but not  more  than  twenty  (20)  seconds
 19    before  the  crossing. If movement of the locomotive engine exceeds forty-five
 20    (45) miles per hour, then the  whistle  will  be  sounded  eighty  (80)  rods,
 21    approximately  one-quarter (1/4) mile, from the place where the railroad cros-
 22    ses any public street, road or highway, and be kept ringing until it has cros-
 23    sed such public street, road or highway, under a penalty of one  hundred  dol-
 24    lars  ($100)  for  every  neglect, to be paid by the corporation operating the
 25    railroad, which may be recovered in an action prosecuted  by  the  prosecuting
 26    attorney  of  the  proper county, for the use of the state. The corporation is
 27    also liable for all damages sustained by any person, and caused by its locomo-
 28    tives, trains or cars, when the provisions of this section  are  not  complied
 29    with.

                       STATEMENT OF PURPOSE

                             RS 15802

Relating to the operation of railroads amending Section 62-412 to
provide required signaling by locomotives for prescribed time and
distances before and at crossing. This brings Idaho Code in line
with federal regulations as well as neighboring states.
