H0470|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 470 BY STONE AND SCHAEFER 1 AN ACT 2 RELATING TO LICENSING OF PASTORAL COUNSELORS; REPEALING SECTION 54-3405A, 3 IDAHO CODE. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 54-3405A, Idaho Code, be, and the same is hereby 6 repealed.
STATEMENT OF PURPOSE
RS 07285
The purpose of this legislation is to repeal Section 54-3405A, Idaho Code, which
provides for licensing and regulation of pastoral counselors, for the following reasons:
(1) Pastoral counseling involves spiritual insight, interpretation, and instruction divine precepts.
These are personal matters beyond the expertise of the state and into which it cannot justly intrude.
(2) The current law:
(a) poses a great potential for regulatory abuse and further government
intrusion in religious matters;
(b) is biased and discriminatory in its approval of pastoral counselors;
(c) is biased and discriminatory in its approval of divine instruction;
(d) is unfairly biased and discriminatory in its minimum education and experience
requirements; and
(e) is biased and exclusionary with regard to accredited institutions and
associations.
