H0513|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 513 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO NATIONAL GUARD; AMENDING SECTION 46-609, IDAHO CODE, TO 3 PROVIDE THAT COMMISSIONED OFFICERS AND ENLISTED PERSONNEL OF THE IDAHO 4 NATIONAL GUARD MAY BE ORDERED TO SPECIAL DUTY WITH OR WITHOUT THEIR CON- 5 SENT, AND TO PROVIDE FOR PAY AND ALLOWANCES IN SUCH CIRCUMSTANCES. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 46-609, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 46-609. OFFICERS AND ENLISTED PERSONNEL ON SPECIAL DUTY -- COMPENSATION 10 AND ALLOWANCES. Commissioned officers and enlisted personnel of the national 11 guard may be ordered upon special duty at the direction of the governor as 12 commander-in-chief,andwith or without their consent, and 13 if with their consent, notwithstanding the provisions of sections 46-605 and 14 46-607, Idaho Code, such duty may be without any pay or allowances, but if 15 without consent, they shall receive thebase pay of their respec-16tive gradessame pay and allowances as prescribed in section 17 46-605, Idaho Code, during the time they may continue upon duty under 18 such order: provided, that in addition to such base pay, while on such19duty, officers and enlisted personnel shall receive the same rental allow-20ances, subsistence allowance, and longevity pay as is paid to officers and21enlisted personnel of like grade in the armed forces of the United States22.
STATEMENT OF PURPOSE

Amends Idaho Code Section 46-609 to permit the governor to order members of the
National Guard to special duty without pay; with the consent of the member. This change
will permit state military authorities to command National Guard members when they
volunteer for special state military duty when there is no need to provide them state military
pay; such as when they are employed by the US Forest Service or the Idaho Department of
Lands to fight wildfires under interagency agreements with the National Guard.
This change will also conform the pay required to be provided under this section for special
duty with pay to that spelled out in section 46-605. This will ensure National Guard
members called to any state military duty with pay will be governed by uniform military pay
rules.
