 1                                        AN ACT
 2    RELATING TO LISTING OF SUBCONTRACTORS ON BID OF GENERAL CONTRACTOR  ON  PUBLIC
 3        WORKS;  AMENDING  SECTION  67-2310, IDAHO CODE, TO PROVIDE THAT LISTING OF
 4        SUBCONTRACTORS ON A GENERAL CONTRACTOR'S BID REQUIRES PERMISSION  OF  SUB-
 5        CONTRACTOR  AND  CONSTITUTES  AN  AGREEMENT TO SUBCONTRACT THE WORK TO THE
 6        NAMED SUBCONTRACTOR IF THE GENERAL CONTRACTOR SECURES THE CONTRACT AND  TO
 7        MAKE A TECHNICAL CORRECTION.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION  1.  That  Section 67-2310, Idaho Code, be, and the same is hereby
10    amended to read as follows:

11        67-2310.  SUBCONTRACTORS TO BE LISTED ON BID OF GENERAL CONTRACTOR.  Here-
12    after,  before  the state of Idaho, the separate counties, cities, towns, vil-
13    lages or school districts within the state of Idaho shall  let  contracts  for
14    the  construction, alteration or repair of any and all buildings, improvements
15    or public works, and such construction, alteration or repair  requires  plumb-
16    ing,  heating  and air-conditioning work, or electrical work, the general con-
17    tractor shall be required to include  in  his  bid  the  name,  or  names  and
18    address,  or addresses, of the subcontractors who shall, in the event the con-
19    tractor secures the contract, subcontract the plumbing, heating and air-condi-
20    tioning  work,  and  electrical  work  under  the  general   contract   .
21      ;  provided   Listing of a subcontractor shall only be
22    done with permission of the subcontractor and constitutes an agreement to sub-
23    contract the work to the named subcontractor if the general contractor secures
24    the contract. Provided , however, that this act shall not apply  to  the
25    construction,  alteration or repair of public buildings under the jurisdiction
26    of the board of regents of the University of  Idaho;  further  that  this  act
27    shall have no application to the preparation and submission of plans and spec-
28    ifications  pursuant to  section 50-1105, Idaho Code   statute
29    or local ordinance . Failure to name subcontractors as required by  this
30    section  shall  render  any bid submitted by a general contractor unresponsive
31    and void.  At the time s    S  ubcontractors    are
32      named  in  accordance  with the provisions of this section , they
33     must possess  an   the  appropriate  license
34    s    or  certificate  s  of competency issued by the state of
35    Idaho covering the contractor work classification in which    the  
36     each respective  subcontractor is named.

    SUBCONTRACTOR NAMING LAW: 67-2310
    
    Provides for a contract between the general contractor and 
    subcontractor. Assures coordination has been accomplished prior to 
    the bid and eliminates "bid shopping" after the low responsive bid 
    has been determined.
