                              BY LOCAL GOVERNMENT COMMITTEE

 1                                        AN ACT
 2    RELATING TO COORDINATION BETWEEN STATE AGENCIES AND LOCAL GOVERNMENTS;  AMEND-
 3        ING  CHAPTER  23,  TITLE  67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
 4        67-2351, IDAHO CODE, TO PROVIDE FOR COORDINATION  BETWEEN  STATE  AGENCIES
 5        AND  CITY AND COUNTY GOVERNMENTS IN LAND USE OR NATURAL RESOURCE PLANNING,
 6        MANAGEMENT AND REGULATORY AUTHORITY.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION 1.  That Chapter 23, Title 67, Idaho Code, be,  and  the  same  is
 9    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
10    known and designated as Section 67-2351, Idaho Code, and to read as follows:

11        67-2351.  COORDINATION WITH LOCAL GOVERNMENTS  --  LAND  USE  AND  NATURAL
12    RESOURCE  PLANNING. (1) Notwithstanding any other provision of law to the con-
13    trary, all state agencies which are involved in land use or  natural  resource
14    planning,  management  and regulatory authority shall coordinate their activi-
15    ties with municipal and county governments whenever the interests of the local
16    government will be potentially affected by the activities of the state agency.
17    The coordination shall initiate at the time of commencement of development  of
18    planning,  management and regulatory activities and shall include coordination
19    in the development of regulatory and policy documents.
20        (2)  All completed land use plans, activity plans or regulatory and policy
21    documents of the state agency shall include a description of the  coordination
22    effort and the results of such effort.

    This proposed legislation would require state agencies to 
    coordinate any proposed land use planning efforts with 
    municipal and county governments when the interests of the 
    local government could be affected by the activities of the 
    state agency.
