H0584|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 584 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO OPERATION OF RAILROADS; AMENDING CHAPTER 4, TITLE 62, IDAHO CODE, 3 BY THE ADDITION OF A NEW SECTION 62-403A, IDAHO CODE, TO REQUIRE A CREW OF 4 AT LEAST TWO INDIVIDUALS ON A RAILROAD TRAIN OR LOCOMOTIVE WHEN THE RAIL- 5 ROAD TRAIN OR LOCOMOTIVE IS OPERATED BETWEEN TERMINALS AND TO AUTHORIZE 6 THE PUBLIC UTILITIES COMMISSION TO PROVIDE AN EXCEPTION TO THE REQUIRE- 7 MENT. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 4, Title 62, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION , to be 11 known and designated as Section 62-403A, Idaho Code, and to read as follows: 12 62-403A. RAILROAD TRAIN CREWS -- EXCEPTION. (1) No person operating or 13 controlling any railroad may allow the operation of any railroad train or 14 locomotive between terminals in this state unless the railroad train or loco- 15 motive has a crew of at least two (2) individuals. 16 (2) The Idaho public utilities commission may, by rule, grant an excep- 17 tion to the requirement provided in subsection (1) of this section if the com- 18 mission determines that the exception will not endanger the life or property 19 of any person.
STATEMENT OF PURPOSE
RS 07737
This bill prohibits any railroad train or locomotive from
operating between terminals in this state unless the crew
consists of at least 2 persons. The bill authorizes the Idaho
Public Utilities Commission to grant exceptions that will not
endanger life or property.
FISCAL NOTE
No fiscal impact is anticipated, as the bill does not increase or
change the responsibilities of the Idaho Public Utilities
Commission.
