 1                                        AN ACT
 2    RELATING TO PUBLIC ASSISTANCE; AMENDING CHAPTER 2, TITLE 56,  IDAHO  CODE,  BY
 3        THE ADDITION OF A NEW SECTION 56-236, IDAHO CODE, TO DIRECT THE DEPARTMENT
 4        OF  HEALTH  AND  WELFARE  TO  RECOVER  PUBLIC ASSISTANCE AWARDED TO ALIENS
 5        LEGALLY IN THE UNITED STATES.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  That Chapter 2, Title 56, Idaho Code,  be,  and  the  same  is
 8    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
 9    known and designated as Section 56-236, Idaho Code, and to read as follows:

10        56-236.  RECOVERY -- ALIEN SPONSORS. The department shall undertake recov-
11    ery of any public assistance obtained by  any  alien  person  legally  in  the
12    United  States  and  receiving  public  assistance.  Recovery  shall be sought
13    against each sponsor who signed and submitted an affidavit  of  support,  form
14    I-864  of the United States department of justice, immigration and naturaliza-
15    tion service. The department shall seek to ensure that further  public  assis-
16    tance is not given until the financial responsibility of the sponsor is met.

                          STATEMENT OF PURPOSE

    To provide for statutory authority for collection, recovery, and 
    administrative rules procedures against any contracted sponsor of a 
    legal immigrant who has received public assistance; and civil 
    penalties to be imposed on sponsors of legal immigrants who fail to 
    fulfill their responsibilities under the contract.
    
                               FISCAL NOTE
    
    It is estimated that approximately 1 million dollars of state 
    taxpayer dollars are disbursed each year on public assistance for 
    legal immigrants who have sponsors and a contractual agreement with 
    the federal government to assume those responsibilities. Our 
    estimate of recovery to Idaho state coffers is estimated at fifty 
    percent (50%) of 1/2 a million dollars annually.
