MANUFACTURED HOMES - Amends existing law to authorize the administrator of
the Division of Building Safety to promulgate rules providing for variances
from certain provisions of the manufactured home setup code or providing
for standardized installation instructions for manufacturers or both and to
provide that, upon the effective date of such rules, the rules shall
prevail.

H0608|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 608 BY BUSINESS COMMITTEE 1 AN ACT 2 RELATING TO THE MANUFACTURED HOME SETUP CODE; AMENDING SECTION 44-2201, IDAHO 3 CODE, TO AUTHORIZE THE ADMINISTRATOR OF THE DIVISION OF BUILDING SAFETY TO 4 PROMULGATE RULES PROVIDING FOR VARIANCES FROM CERTAIN PROVISIONS OF THE 5 SETUP CODE OR PROVIDING FOR STANDARDIZED INSTALLATION INSTRUCTIONS FOR 6 MANUFACTURERS, OR BOTH, AND TO PROVIDE THAT, UPON THE EFFECTIVE DATE OF 7 SUCH RULES, THE RULES SHALL PREVAIL. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 44-2201, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 44-2201. MOBILE/MANUFACTURED HOMES INSTALLATION. (1) All 12 mobile/manufactured homes must be installed in accordance with the 13 manufacturer's instructions or where the manufacturer's instructions are not 14 readily available from the manufacturer, the mobile/manufactured home must be 15 installed in accordance with the provisions of this chapter. All 16 mobile/manufactured homes must be installed in accordance with all other 17 applicable state laws pertaining to utility connection requirements. If the 18 home is installed in accordance with the manufacturer's specifications, a copy 19 of those specifications shall be in the home at the time of setup and inspec- 20 tion. If the home is installed in accordance with the provisions of this chap- 21 ter, then a copy of the state setup requirements shall be included with the 22 home. All dimensions required by the provisions of this chapter are considered 23 to be nominal. 24 (2) The administrator of the division of building safety may pro- 25 mulgate rules in accordance with the provisions of chapter 52, title 67, Idaho 26 Code, providing for variances from the installation requirements specified in 27 sections 44-2204 and 44-2205, Idaho Code, or specifying standardized installa- 28 tion instructions for manufacturers, or both. Upon the effective date of such 29 rules, the rules shall prevail over any conflicting provisions in this chap- 30 ter. 31 (3) The homeowner or park owner must ensure that the ground 32 on which a mobile/manufactured home is to be installed has been improved as 33 necessary to provide a proper base for the unit and that the area beneath it 34 has adequate drainage.
STATEMENT OF PURPOSE
RS 07446
This legislation authorizes the Division of Building Services
to promulgate rules which would permit the adoption of
variances from the current installation standards for
manufactured homes found in Sections 44-2204 and 44-2205 of
the Idaho Code.
FISCAL NOTE
Other than the cost associated with rule promulgation, there
is
no fiscal impact.
