                                    HOUSE BILL NO. 625

 1                                        AN ACT
 2    RELATING TO RELEASE TIME FOR RELIGIOUS INSTRUCTION; AMENDING  SECTION  33-519,
 3        IDAHO CODE, TO ACCOMMODATE RELEASE TIME IN VARIOUS CLASS SCHEDULE ARRANGE-
 4        MENTS.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section  33-519, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        33-519.  RELEASE FOR RELIGIOUS INSTRUCTION. Upon application of his parent
 9    or guardian, or, if the student has attained the age of eighteen  (18)  years,
10    upon application of the student, a student attending a public school in grades
11    nine  (9)  through  twelve  (12)  may  be excused from school for a period not
12    exceeding five (5) periods in any week and not  exceeding    one  hundred
13    sixty-five  (165)   two hundred fifteen (215)  hours per stu-
14    dent during any one (1) school year for religious or other  purposes.  Release
15    time pursuant to this section shall be scheduled by the board of trustees upon
16    application  as provided herein and the board shall have reasonable discretion
17    over the scheduling and timing of the release time. Release time  pursuant  to
18    this  section shall not reduce the minimum graduation requirements for accred-
19    ited Idaho high schools. The provisions of this section shall not be deemed to
20    authorize the use of any public school facility for religious instruction. The
21    board of trustees of a school district may not authorize the use of, and  pub-
22    lic school facilities, personnel or equipment may not be utilized, to maintain
23    attendance  records  for  the  benefit  of  release time classes for religious
24    instruction. No credit shall be awarded by the school or school  district  for
25    completion  of courses during release time for religious purposes. At the dis-
26    cretion of the board credit may be granted for other purposes.
