                         BY TRANSPORTATION AND DEFENSE COMMITTEE

 1                                        AN ACT
 2    RELATING TO HIGHWAYS; AMENDING SECTION 40-1305G, IDAHO CODE, TO  INCREASE  THE
 3        TIME FOR WRITE-IN CANDIDATES TO FILE A DECLARATION OF INTENT.

 4    Be It Enacted by the Legislature of the State of Idaho:

 5        SECTION  1.  That Section 40-1305G, Idaho Code, be, and the same is hereby
 6    amended to read as follows:

 7        40-1305G.  WRITE-IN CANDIDATES. No write-in  candidate  for  any  elective
 8    office shall be counted unless a declaration of intent has been filed indicat-
 9    ing  that the person desires the office and is legally qualified to assume the
10    duties of the office. The declaration of intent shall be filed with the  high-
11    way district election official not less than  eleven   twenty-
12    five  ( 11  25 ) days before the date of the elec-
13    tion. The election official shall verify the legal qualification of the write-
14    in candidate.

                          STATEMENT OF PURPOSE

    This legislation makes a correction in Section 40-1305G, Idaho 
    code, changing the declaration of intent for write in candidates 
    for Highway District Commissioner elections. The change is 
    increasing the time limit from 11 days to 25 days. The need for 
    this legislation is as a result of the changes made last session 
    to Title 34, Chapter 1407.
