                       HOUSE BILL NO. 751, As Amended in the Senate

 1                                        AN ACT
 2    RELATING TO SALARIES OF ELECTIVE  OFFICERS;  AMENDING  SECTION  59-501,  IDAHO
 3        CODE, TO PROVIDE THAT THE SALARIES OF ELECTIVE OFFICERS SHALL BE INCREASED
 4        BY  SPECIFIC AMOUNTS ON THE FIRST MONDAY OF JANUARY OF THE YEARS SPECIFIED
 5        AND TO PROVIDE TECHNICAL CORRECTIONS.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  That Section 59-501, Idaho Code, be, and the  same  is  hereby
 8    amended to read as follows:

 9        59-501.  SALARIES OF STATE ELECTIVE OFFICERS -- REGULAR PAYMENT -- TRAVEL-
10    ING  EXPENSES  -- FEES PROPERTY OF STATE.  (1)  The governor, lieu-
11    tenant governor, secretary of state, state controller, state treasurer, attor-
12    ney general and superintendent of public instruction shall, during their  con-
13    tinuance  in office,  and commencing on the first Monday in January, 1991
14     receive for their services compensation as follows:
15         Commencing on the first Monday in January 1999, until the first Mon-
16    day in January 2000: 
17        Governor, $ 85,000  92,500  per annum;
18        Lieutenant governor, $ 22,500  24,500  per annum;
19        Secretary of state, $ 67,500  75,000  per annum;
20        State controller, $ 67,500  75,000  per annum;  said
21    salary to be audited by the legislative council;
22        Attorney general, $ 75,000  82,500  per annum;
23        State treasurer, $ 67,500  75,000  per annum; and
24        State  superintendent  of  public  instruction,  $ 67,500 
25    75,000  per annum.
26         Commencing on the first Monday in January 2000, until the first Mon-
27    day in January 2001:
28        Governor, $95,500 per annum;
29        Lieutenant governor, $25,250 per annum;
30        Secretary of state, $77,500 per annum;
31        State controller, $77,500 per annum; said salary to be audited by the leg-
32    islative council;
33        Attorney general, $85,500 per annum;
34        State treasurer, $77,500 per annum; and
35        State superintendent of public instruction, $77,500 per annum.
36        Commencing on the first Monday in January 2001, until the first Monday  in
37    January 2002:
38        Governor, $98,500 per annum;
39        Lieutenant governor, $26,000 per annum;
40        Secretary of state, $80,000 per annum;
41        State controller, $80,000 per annum; said salary to be audited by the leg-
42    islative council;
43        Attorney general, $88,500 per annum;

 1        State treasurer, $80,000 per annum; and
 2        State superintendent of public instruction, $80,000 per annum.
 3        Commencing  on the first Monday in January 2002, until the first Monday in
 4    January 2003:
 5        Governor, $101,500 per annum;
 6        Lieutenant governor, $26,750 per annum;
 7        Secretary of state, $82,500 per annum;
 8        State controller, $82,500 per annum; said salary to be audited by the leg-
 9    islative council;
10        Attorney general, $91,500 per annum;
11        State treasurer, $82,500 per annum; and
12        State superintendent of public instruction, $82,500 per annum. 
13         (2)   Such compensation shall be paid on regular  pay  periods
14    as  due  out  of  the state treasury, and shall be in full for all services by
15    said officers respectively rendered in any  official  capacity  or  employment
16    whatever during their respective terms of office; but no increase  in the
17    rate    of compensation shall  affect the salaries of such officers
18      be made  during  their present   the 
19    terms of  such  office rs ; provided, however, that  the
20    actual  and necessary expenses of the governor, lieutenant governor, secretary
21    of state, attorney general, state controller, state  treasurer,  and  superin-
22    tendent  of  public  instruction  while traveling within the state, or between
23    points within the state, in the  performance  of  official  duties,  shall  be
24    allowed  and  paid  by  the state; not however, exceeding such sum as shall be
25    appropriated for such purpose.
26         (3)   Actual and necessary subsistence expenses of the  gover-
27    nor  while traveling in connection with the performance of official duties are
28    hereby expressly exempted from the provisions of sections 67-2007 and 67-2008,
29    Idaho Code. (Standard Travel Pay and Allowance Act of 1949).
30         (4)   No officer named in this section shall receive, for  the
31    performance  of  any official duty any fee for his own use, but all fees fixed
32    by law for the performance by either of them, of any official duty,  shall  be
33    collected  in  advance and deposited with the state treasurer to the credit of
34    the state.

The purpose of this legislation is to provide for a three percent (3%)
increase in the salaries for State elected officials for the years 1999
through 2002.
