 1                                        AN ACT
 2    RELATING TO SPECIALTY ELECTRICIANS; AMENDING CHAPTER 10, TITLE 54, IDAHO CODE,
 3        BY THE ADDITION OF A NEW SECTION 54-1020, IDAHO CODE, TO PROVIDE FOR ISSU-
 4        ANCE OF LICENSES TO SPECIALTY ELECTRICIANS BY  THE  ADMINISTRATOR  OF  THE
 5        DIVISION  OF BUILDING SAFETY, TO PROVIDE FOR RULES FOR THE EXAMINATION AND
 6        LICENSING OF SPECIALTY ELECTRICIANS AND TO ESTABLISH  CLASSIFICATIONS  FOR
 7        SPECIALTY  ELECTRICIAN  LICENSING,  TO PROVIDE A DEFINITION AND TO PROVIDE
 8        THAT LICENSURE OF SPECIALTY ELECTRICIANS SHALL BE EXCLUSIVE TO THE  STATE;
 9        DECLARING AN EMERGENCY; AND PROVIDING A SUNSET CLAUSE.

10    Be It Enacted by the Legislature of the State of Idaho:

11        SECTION  1.  That  Chapter  10,  Title 54, Idaho Code, be, and the same is
12    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
13    known and designated as Section 54-1020, Idaho Code, and to read as follows:

14        54-1020.  SPECIALTY  ELECTRICIANS -- EXAMINATION AND LICENSING -- RULES --
15    LICENSURE AUTHORITY EXCLUSIVE TO THE STATE. (1) The administrator of the divi-
16    sion of building safety is authorized to conduct examinations, pass  upon  the
17    qualifications  of  applicants  and  to  grant and issue licenses to qualified
18    applicants to engage in the trade or business of specialty  electrician.  Such
19    licenses  shall  not  be  transferable.  The  administrator  is authorized and
20    directed to enforce rules promulgated by the Idaho electrical  board  for  the
21    examination and licensing of specialty electricians.
22        (2)  The  Idaho  electrical board is authorized and directed to promulgate
23    rules for the examination and licensing  of  specialty  electricians  and  for
24    classifications of specialty electrician licensing.
25        (3)  "Specialty  electrician" means a person having the necessary qualifi-
26    cations, training, experience  and  technical  knowledge  to  install,  alter,
27    repair  and supervise the installing, altering or repairing of special classes
28    of electrical wiring, apparatus or equipment for light, heat, power and  other
29    purposes or for special classes of electrical work.
30        (4)  Licensure  of  specialty  electricians  shall be within the exclusive
31    jurisdiction of the state and no local jurisdiction shall have  the  authority
32    to require additional licensure or to issue licenses to specialty electricians
33    licensed under this chapter which are inconsistent with the provisions of this
34    chapter or rules promulgated by the division of building safety.

35        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
36    declared to exist, this act shall be in full force and effect on and after its
37    passage and approval.

38        SECTION 3.  The provisions of this act shall be null, void and of no force
39    and effect on and after June 30, 1999.

                            STATEMENT OF PURPOSE
                                  RS 08210
    
    This legislation will establish a specialty electrician's license to be issued 
    by the Division of Building Safety, and will limit the issuance of specialty 
    electrician licenses exclusively to the State of Idaho. The legislation also 
    includes an emergency clause.
