 1                                        AN ACT
 2    RELATING TO THE BEAN COMMISSION; AMENDING SECTION 22-2912, IDAHO CODE, TO PRO-
 3        VIDE A DIFFERENT COMPENSATION SCHEDULE AND TO  PROVIDE  THAT  COMPENSATION
 4        PAID TO MEMBERS OF THE BEAN COMMISSION ON AND AFTER JANUARY 1, 1998, SHALL
 5        NOT BE CONSIDERED SALARY AS DEFINED IN THE PUBLIC EMPLOYEE RETIREMENT SYS-
 6        TEM  LAW;  DECLARING  AN  EMERGENCY  AND PROVIDING A RETROACTIVE EFFECTIVE
 7        DATE.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  That Section 22-2912, Idaho Code, be, and the same  is  hereby
10    amended to read as follows:

11        22-2912.  BEAN COMMISSION CREATED. There is hereby created and established
12    in  the department of self-governing agencies the Idaho bean commission, here-
13    inafter called the commission. It shall be composed of nine (9) men  or  women
14    engaged  in the bean industry. The commission shall be appointed by the gover-
15    nor, and each member must have been a resident of the state  of  Idaho  for  a
16    period of three (3) years immediately prior to his appointment, shall have had
17    active  experience in growing, processing or shipping of beans produced in the
18    state of Idaho, and at least five (5) members of the commission shall be grow-
19    ers actually engaged in production of beans, but who are not handlers, dealers
20    or processors. One (1) grower member of the commission shall be appointed from
21    each of the districts provided for by this section.  The  four  (4)  remaining
22    members  of  the  commission  may  be engaged in the processing or shipping of
23    beans, at least one (1) of whom must be engaged in the processing or  shipping
24    of snap bean seed. The processor or shipper members of the commission shall be
25    appointed  at  large, keeping in mind insofar as possible geographic locations
26    representative of the Idaho bean industry. The qualifications  for  membership
27    on  the commission shall continue throughout the respective terms of office of
28    the commissioners. Upon recommendation of organizations of producers and ship-
29    pers of beans, one (1) grower commissioner shall be  appointed  from  district
30    No.  1,  which district shall be composed of the following counties: Boundary,
31    Bonner, Kootenai, Benewah, Shoshone, Latah, Clearwater, Nez Perce,  Lewis  and
32    Idaho;  one  (1)  grower  commissioner shall be appointed from district No. 2,
33    which district shall be composed of the  following  counties:  Adams,  Valley,
34    Lemhi, Custer, Boise, Washington, Payette, Gem, Canyon and Ada; one (1) grower
35    commissioner  shall  be appointed from district No. 3, which district shall be
36    composed of the following counties: Twin Falls, Owyhee  and  Elmore;  one  (1)
37    grower  commissioner  shall  be  appointed from district No. 4, which district
38    shall be composed of the following counties: Cassia, Oneida,  Power,  Bannock,
39    Caribou,  Bear  Lake, Franklin and Minidoka; one (1) grower commissioner shall
40    be appointed from district No. 5, which district shall be composed of the fol-
41    lowing counties: Camas, Blaine, Gooding, Lincoln, Jerome, Bingham, Bonneville,
42    Butte, Jefferson, Madison, Teton, Fremont and Clark.  Commencing  on  July  1,
43    1971  and  July  1,  1973,  when  the  terms of the present commission members

 1    expire, the next regularly appointed grower members for districts  No.  1  and
 2    No.  2  will  hold  office  for  a  term  of  one (1) year; the next regularly
 3    appointed grower member from district No. 3 will hold office  for  a  term  of
 4    four  (4) years; the next regularly appointed grower member for district No. 4
 5    will hold office for a term of one (1)  year;  the  next  regularly  appointed
 6    grower  member  from  district  No.  5 will hold office for a term of four (4)
 7    years. Also, commencing on July 1, 1971 and July 1, 1973, when  the  terms  of
 8    the  present processor or shipper members, who were appointed heretofore  from
 9    districts 2, 3, 4 and 5, expire, the processor or  shipper  members  replacing
10    the heretofore appointed processor or shipper members will serve the following
11    terms: the processor or shipper member who is appointed to replace the proces-
12    sor  or shipper member appointed from district No. 2 will serve a term of four
13    (4) years; the processor or shipper member who is  appointed  to  replace  the
14    processor or shipper member appointed from district No. 3 will serve a term of
15    three  (3)  years; the processor or shipper member who is appointed to replace
16    the processor or shipper member appointed from district No.  4  will  serve  a
17    term  of  four  (4) years; the processor or shipper member who is appointed to
18    replace the processor or shipper member appointed from  district  No.  5  will
19    serve  a  term of three (3) years. Thereafter, the governor shall appoint com-
20    missioners as their terms expire. Each commissioner shall serve for a term  of
21    four  (4)  years.  Each commissioner shall hold office until his successor has
22    been appointed.
23        A simple majority of members of the commission shall constitute  a  quorum
24    for the transaction of business and for carrying out the duties of the commis-
25    sion.  All  commissioners shall take an oath of office before commencing their
26    duties.
27        Each member of the commission shall be compensated as provided by  section
28    59-509( d  j ), Idaho Code , provided however, that
29    compensation  paid  to members of the commission on and after January 1, 1998,
30    shall not be considered salary as  defined  in  section  59-1302,  Idaho  Code
31    .

32        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
33    declared to exist, this act shall be in full force and effect on and after its
34    passage and approval, and retroactively to January 1, 1998.

                           STATEMENT OF PURPOSE

    This legislation exempts members of the Bean Commission from Public Employee Retirement System 
    of Idaho (PEPSI) membership.
    
                              FISCAL IMPACT
    
    This legislation would have a positive overall fiscal impact on state finances since it would relieve the 
    commission of payment of employer contributions to PERSI. It would also remove the retirement 
    liability for the bean commissioners.
