                               BY APPROPRIATIONS COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE BOARD OF EXAMINERS; AMENDING CHAPTER 8, TITLE 57, IDAHO  CODE,
 3        BY  THE  ADDITION OF A NEW SECTION 57-814A, IDAHO CODE, TO ALLOW THE BOARD
 4        OF EXAMINERS TO TRANSFER MONEYS FROM THE BUDGET  RESERVE  ACCOUNT  TO  THE
 5        GENERAL FUND AT FISCAL YEAR END UNDER CERTAIN CIRCUMSTANCES.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Chapter  8,  Title  57, Idaho Code, be, and the same is
 8    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
 9    known and designated as Section 57-814A, Idaho Code, and to read as follows:

10        57-814A.  TRANSFER FROM BUDGET RESERVE ACCOUNT TO GENERAL FUND. At the end
11    of  the  fiscal year, if the state board of examiners determines that insuffi-
12    cient general fund moneys are available to meet  the  level  of  general  fund
13    appropriations  authorized  by  the legislature for that same fiscal year, the
14    board is hereby authorized to transfer certain unencumbered  moneys  from  the
15    budget  reserve  account to the general fund. Such transfers will be the final
16    accounting adjustment to close the fiscal year and shall  be  limited  to  the
17    amount  of  the insufficiency or one-half of one percent (.5%) of the original
18    general fund appropriations made for the fiscal year just ending, whichever is
19    less. Any transfer made pursuant to  this  section  from  the  budget  reserve
20    account  to the general fund shall be specifically addressed in the governor's
21    executive budget recommendation for the following year which is  then  subject
22    to review or action by the legislature.
