                             IN THE HOUSE OF REPRESENTATIVES

                            HOUSE CONCURRENT RESOLUTION NO. 35

                             BY HEALTH AND WELFARE COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF  THE  BOARD
 3        OF   PHARMACY   RELATING  TO  ELECTRONIC  TRANSMISSION  OF  PRESCRIPTIONS,
 4        PHARMACOTHERAPY AND PHARMACY TECHNICIANS.

 5    Be It Resolved by the Legislature of the State of Idaho:

 6        WHEREAS, the Legislature is vested  with  authority  to  reject  executive
 7    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
 8    that  the Legislature finds that the rules are not consistent with legislative
 9    intent; and
10        WHEREAS, it is the finding of the Legislature that certain  rules  of  the
11    Board  of  Pharmacy  relating  to  electronic  transmission  of prescriptions,
12    pharmacotherapy, and pharmacy technicians are not consistent with  legislative
13    intent and should be rejected.
14        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
15    sion of the Fifty-fourth Idaho Legislature, the House of  Representatives  and
16    the  Senate  concurring therein, that IDAPA 27.01.01.162, rule of the Board of
17    Pharmacy relating to electronic transmission of prescriptions,  adopted  as  a
18    pending rule under Docket number 27-0101-9701, IDAPA 27.01.01.165, rule of the
19    Board of Pharmacy relating to pharmacotherapy, adopted as a pending rule under
20    Docket number 27-0101-9701, and IDAPA 27.01.01.251, rule of the Board of Phar-
21    macy  relating to pharmacy technicians, adopted as a pending rule under Docket
22    number 27-0101-9701, be, and the same are hereby rejected and  declared  null,
23    void and of no force and effect.

    This resolution would reject a certain rules of the Board of Pharmacy 
    relating to electronic transmission of prescriptions, pharmacotherapy 
    and pharmacy technicians.
