S1308|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1308 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO A NONCUSTODIAL PARENT'S ACCESS TO A CHILD'S RECORDS; AMENDING SEC- 3 TION 32-717A, IDAHO CODE, TO PROVIDE THAT A MINOR CHILD'S ADDRESS SHALL BE 4 DELETED FROM THE CHILD'S MEDICAL, DENTAL, HEALTH, SCHOOL OR EDUCATIONAL 5 RECORDS UPON THE WRITTEN REQUEST OF THE CUSTODIAL PARENT. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 32-717A, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 32-717A. PARENTS' ACCESS TO RECORDS AND INFORMATION. Notwithstanding any 10 other provisions of law, access to records and information pertaining to a 11 minor child including, but not limited to, medical, dental, health, and school 12 or educational records, shall not be denied to a parent because the parent is 13 not the child's custodial parent. However, information concerning the 14 minor child's address shall be deleted from such records to a parent, if the 15 custodial parent has advised the records custodian in writing to do so.
STATEMENT OF PURPOSE

This bill is one of a series of bills that the Justices
of the Supreme Court transmitted to the Governor in their
annual "defects in the laws" report under Art. 5, Sec. 25 of
the Idaho Constitution.
Idaho Code ยง32-717A provides that "notwithstanding any
other provisions of law" a noncustodial parent shall have
access to a child's medical, dental, health, and school
records. This language allows a noncustodial parent who has
committed spousal abuse to learn the location of the other
spouse simply by having access to the child's school or
medical records.
This bill amends this statute by providing that the
miner child's address shall be deleted from these records if
requested in writing by the custodial parent.
FISCAL NOTE
This bill will not have an impact on state or local
funds.
