S1379|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1379, As Amended in the House BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO THE BIG PAYETTE LAKE MANAGEMENT PLAN; ACCEPTING THE BIG PAYETTE 3 LAKE MANAGEMENT PLAN AS ESTABLISHED AND APPROVED BY THE BIG PAYETTE LAKE 4 WATER QUALITY COUNCIL; AND PROVIDING LEGISLATIVE INTENT. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. Pursuant to the requirements of Section 39-6611, Idaho Code, 7 the Legislature of the State of Idaho does hereby accept the Big Payette Lake 8 Management Plan, as established and approved by the Big Payette Lake Water 9 Quality Council on December 1, 1997. 10 SECTION 2. It is the intent of the Legislature, with regard to the Big 11 Payette Lake Management Plan, that when a minimum stream flow is contemplated, 12 the minimum stream flow must be gained under the provisions of Sections 13 42-1501 through 42-1505, Idaho Code.
STATEMENT OF PURPOSE

The purpose of this legislation is to provide for legislative
acceptance of the Big Payette Lake Management Plan. The Plan
was established and approved by the Big Payette Lake Water
Quality Council pursuant to the Big Payette Lake Water Quality
Act, Title 39, Chapter 66, Idaho Code. The Big Payette Lake Water
Quality
Act established the Big Payette Lake Water Quality Council in
order to implement a program to protect, preserve and, where
necessary, improve the water quality of the Big Payette Lake
while accommodating private, public and commercial activities to
the extent prudent and practicable. The Big Payette Water
Quality Act provides that the Council shall create and present
to the Legislature for the Legislature's acceptance, rejection
or modification, a management plan to accomplish the purposes
set forth in the Act. Such a lake management plan was
established and approved by the Council on December 1, 1997.
This legislation is intended to provide for legislative
acceptance of the Plan pursuant to the Big Payette Lake Water
Quality Act, Section 396611, Idaho Code .
