                                   SENATE BILL NO. 1402

                             BY JUDICIARY AND RULES COMMITTEE

 1                                        AN ACT
 2    RELATING TO INTERRUPTION OF AN EMERGENCY TELEPHONE CALL; AMENDING CHAPTER  67,
 3        TITLE  18,  IDAHO  CODE,  BY THE ADDITION OF A NEW SECTION 18-6711B, IDAHO
 4        CODE, TO PROVIDE FOR THE CRIME OF MALICIOUS INTERRUPTION OF  AN  EMERGENCY
 5        TELEPHONE CALL, TO PROVIDE PENALTIES AND TO PROVIDE A DEFINITION.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Chapter  67,  Title 18, Idaho Code, be, and the same is
 8    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
 9    known and designated as Section 18-6711B, Idaho Code, and to read as follows:

10        18-6711B.  INTERRUPTION  OF  EMERGENCY TELEPHONE CALL. (1)  Any person who
11    maliciously interrupts any person calling or attempting  to  call  the  number
12    "911" or other police or medical emergency number from either a public or pri-
13    vate telephone for the purpose of making a report or complaint of an emergency
14    nature,  either  by taking down, removal or injury of a telephone for the pur-
15    pose of stopping the emergency transmission of information, shall be guilty of
16    a felony and shall be punishable by imprisonment in the  state  prison  for  a
17    term  not  exceeding five (5) years, or by a fine not exceeding fifty thousand
18    dollars ($50,000), or by both.
19        (2)  For purposes of this section, the term  "telephone"  shall  mean  any
20    device  which  provides  or facilitates the transmission of messages, signals,
21    facsimiles, video images or other communication between persons who are physi-
22    cally separated from each other by means of telephone, telegraph, cable,  wire
23    or  the  projection  of energy without physical connection (wireless or cellu-
24    lar).

    INTERRUPTION OF EMERGENCY TELEPHONE CALL
    
    The purpose of this legislation is to provide felony punishment for those who intentionally interrupt 
    a person communicating with 9 l l emergency services.
    
                              FISCAL IMPACT
    
    There should be little or no fiscal impact with this legislation as this is another tool law enforcement 
    may use in domestic violence situations where other crimes are being committed. The long term fiscal 
    impact should be positive because intervention has been shown to reduce the recurrence of domestic 
    violence both in this generation and in the generation growing up in homes with domestic violence.
