                                   SENATE BILL NO. 1414

                          BY RESOURCES AND ENVIRONMENT COMMITTEE

 1                                        AN ACT
 2    RELATING TO FISH AND GAME; AMENDING SECTION 36-412, IDAHO  CODE,  TO  INCREASE
 3        HUNTER EDUCATION FEES.

 4    Be It Enacted by the Legislature of the State of Idaho:

 5        SECTION  1.  That  Section  36-412, Idaho Code, be, and the same is hereby
 6    amended to read as follows:

 7        36-412.  EDUCATION PROGRAMS -- INSTRUCTOR QUALIFICATIONS -- FEE.  (a)  The
 8    fish  and game commission shall prescribe and administer education programs in
 9    hunting and archery. Such programs  shall  provide  instruction  in  the  safe
10    handling of lawful hunting equipment. The programs shall also include instruc-
11    tion  on  wildlife and natural resource conservation, good conduct and respect
12    for the rights and property of others, and survival in the outdoors. The  com-
13    mission may enter into agreements with public or private agencies and individ-
14    uals in carrying out the provisions of this subsection.
15        (b)  The  department  of  fish  and game shall recruit competent volunteer
16    instructors. The department shall provide training for the instructors in  the
17    safe handling of legal hunting equipment, conservation of wildlife and natural
18    resources,  good  conduct  and  respect for the rights and property of others,
19    outdoor survival, and other appropriate  subjects  for  training  instructors.
20    Instructors  shall be issued certificates and shall on a voluntary basis, give
21    instruction in education programs as established by the department of fish and
22    game, to all eligible applicants.
23        (c)  The commission shall establish fees for each program  not  to  exceed
24      three      eight    dollars  ($  3   8
25    .00) for persons who are seventeen (17)  years  and  under  and  not  to
26    exceed    five    eight  dollars ($ 5  8
27    .00) for persons age eighteen (18) years and older, to be assessed  each
28    individual  obtaining  instruction  in  hunter education for reimbursement for
29    furnished materials.  All  students  successfully  completing  the  course  of
30    instruction  shall  be issued a certificate of completion in hunter safety and
31    good hunting conduct.

    The purpose of this legislation is to amend Section 36-412 to change the 
    fees for attending a hunter safety course to $8 to reimburse the 
    Department of Fish and Game for the cost of furnished materials. 
    Currently, the course cost is below the actual cost of the materials.
    
    FISCAL NOTE
    
    Approximately 10,000 students take hunter education per year. The new 
    fee structure would result in about $50,000 additionally per year to 
    reimburse the Department of Fish and Game for the educational materials.
