                                   SENATE BILL NO. 1425

                             BY JUDICIARY AND RULES COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE CHAIRMAN OF THE BOARD OF CORRECTION; AMENDING SECTION  20-202,
 3        IDAHO CODE, TO PROVIDE THAT THE GOVERNOR SHALL DESIGNATE ONE MEMBER OF THE
 4        BOARD TO SERVE AS CHAIRMAN.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section  20-202, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        20-202.  INTERIM APPOINTMENTS -- CHAIRMAN. In the event of death,  removal
 9    or  resignation  of  any  member of the board, the governor shall appoint some
10    competent person to serve during the unexpired term.  The  governor    in
11    first  appointing  such  members,  shall designate one (1) of them to serve as
12    chairman. The board shall elect his successor from among  its  members  
13     shall designate one (1) member of the board to serve as chairman .

                         STATEMENT OF PURPOSE

    The purpose of this bill is to amend Idaho Code Section 20-202, concerning the appointment of the 
    chairman of the Board of Correction. Currently,  the statute provides for the board members to elect the 
    chairman. This amendment would allow the govemor to designate the chairman.
