                                   SENATE BILL NO. 1432

                               BY TRANSPORTATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO CITIES; AMENDING SECTION  50-301,  IDAHO  CODE,  TO  PROVIDE  THAT
 3        JURISDICTION OVER CITY STREETS IS APPLICABLE ONLY TO CITIES WITH FUNCTION-
 4        ING STREET DEPARTMENTS.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section  50-301, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        50-301.  CORPORATE AND LOCAL SELF-GOVERNMENT POWERS.  (1)  Cit-
 9    ies governed by this act shall be bodies corporate and politic; may sue and be
10    sued; contract and be contracted with; accept grants-in-aid and gifts of prop-
11    erty, both real and personal, in the name of the city; acquire,  hold,  lease,
12    and  convey  property,  real  and personal; have a common seal, which they may
13    change and alter at pleasure; may erect buildings or structures of  any  kind,
14    needful for the uses or purposes of the city; and exercise all powers and per-
15    form all functions of local self-government in city affairs as are not specif-
16    ically  prohibited by or in conflict with the general laws or the constitution
17    of the state of Idaho.
18         (2)  Jurisdiction over city streets as provided in this  chapter  is
19    applicable  only  to  cities with functioning street departments as defined in
20    section 40-104, Idaho Code, and section 50-1301, Idaho Code.

                           STATEMENT OF PURPOSE

    This legislation makes a technical correction to Title 50 of 
    Idaho Code, Section 301. The change inserts the language 
    "Functioning Street Department". This language is found in 
    501301, however, there has been some confusion within cities 
    that do not have a functioning street department and the 
    disposition of city streets.
