                                   SENATE BILL NO. 1528

                                BY STATE AFFAIRS COMMITTEE

 1                                        AN ACT
 2    RELATING TO ELECTION PRECINCTS; AMENDING CHAPTER 3, TITLE 34, IDAHO  CODE,  BY
 3        THE ADDITION OF A NEW SECTION 34-307, IDAHO CODE, TO PROVIDE THAT PRECINCT
 4        BOUNDARIES SHALL BE MAINTAINED WITHIN A SPECIFIED TIME PERIOD; AND DECLAR-
 5        ING AN EMERGENCY.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Chapter  3,  Title  34, Idaho Code, be, and the same is
 8    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
 9    known and designated as Section 34-307, Idaho Code, and to read as follows:

10        34-307.  PRECINCT  BOUNDARIES MAINTAINED. From January 15 in any year end-
11    ing in 8 through September 15 in any year ending in 1,  the  board  of  county
12    commissioners shall make no changes in precinct boundaries, except that a sin-
13    gle  precinct  may  be  divided into two (2) or more new precincts wholly con-
14    tained within the original precinct.

15        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
16    declared to exist, this act shall be in full force and effect on and after its
17    passage and approval.

                           STATEMENT OF PURPOSE
    
                                 RS 07563
    
    The purpose of this legislation is to freeze voting precinct 
    boundaries from January 15 of a year ending in 8 through 
    September 15 of a year ending in 1. The Census Bureau 
    requires that precinct boundaries be submitted in 1998 for 
    the Census 2000. This bill will allow the submission of 
    precinct boundaries to the Census Bureau and the use of these 
    precincts by the Commission on Reapportionment without any 
    change in the boundaries.
