S1230|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1230 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO THE LOCAL PLANNING ACT; AMENDING CHAPTER 65, TITLE 67, IDAHO CODE, 3 BY THE ADDITION OF A NEW SECTION 67-6538, IDAHO CODE, TO PROVIDE FOR COOR- 4 DINATION OF STATE AGENCIES AND COUNTIES OF CERTAIN PLANNING PROCESSES. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Chapter 65, Title 67, Idaho Code, be, and the same is 7 hereby amended by the addition thereto of a NEW SECTION , to be 8 known and designated as Section 67-6538, Idaho Code, and to read as follows: 9 67-6538. COORDINATION BY STATE AGENCIES AND COUNTIES. The clerk of any 10 county which is engaged in a land use planning process substantially in com- 11 pliance with the provisions of this chapter for federal and state land lying 12 within its boundaries may notify affected state agencies that the county is 13 engaged in such planning process and wishes to coordinate its planning with 14 the state agency. Whenever a state agency initiates planning for an action 15 that may affect the use of federal or state land in a county which has advised 16 the agency of its land use planning process and desire to coordinate planning, 17 the state agency shall coordinate its action plan with the affected county and 18 with the federal and state land use plan of such county.

The intent of this legislation is to require State Agencies to
co-ordinate their efforts with Counties involved in the Land
Use Planning process for Federal and State lands lying with-in
their boundaries.
