HCR025|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 25 BY REVENUE AND TAXATION COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING LEGISLATIVE FINDINGS AND SEEKING CONGRESSIONAL REAFFIRMATION OF SUP- 3 PORT FOR STATE SOVEREIGNTY OVER WATER AND FISH AND WILDLIFE RESOURCES. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature of the State of Idaho recognizes the vital con- 6 tributions water, fish and wildlife provide to the state's economic well-being 7 and to the state's quality of life; and 8 WHEREAS, the Legislature of the State of Idaho supports the continued mul- 9 tiple uses of its water for fish and wildlife, hydropower generation, irriga- 10 tion, transportation, flood control and recreation; and 11 WHEREAS, Congress has historically deferred to state water law; and 12 WHEREAS, states have traditionally been responsible for the management of 13 their fish and wildlife resources; and 14 WHEREAS, the Legislature of the State of Idaho has enacted comprehensive 15 statutory schemes for the allocation of water and for the management of fish 16 and wildlife; and 17 WHEREAS, various federal agencies under the auspices of the Endangered 18 Species Act are preempting or interfering with Idaho's management of its fish 19 and wildlife resources and seeking releases of water from reservoirs within 20 Idaho for anadromous fish; and 21 WHEREAS, there is no evidence to show that releases of water from Idaho 22 reservoirs will result in the recovery of the listed anadromous fish; and 23 WHEREAS, the Legislature of the State of Idaho believes that water taken 24 from the state for anadromous fish enhancement efforts would inflict on the 25 citizenry of the state a loss of recreational opportunities, an increase in 26 electrical rates, a loss of recharge water for the state's aquifers, a reduc- 27 tion in economic activity and quality of life; and 28 WHEREAS, the above-mentioned activities would create water shortages 29 within the state resulting in the idling of a large acreage of productive 30 Idaho farmland; and 31 WHEREAS, the Legislature of the State of Idaho recognizes the need to pro- 32 tect and enhance anadromous fish populations and will work to accomplish this 33 while also protecting the needs of the citizens of the state through state 34 law. 35 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 36 of the Fifty-fifth Idaho Legislature, the House of Representatives and the 37 Senate concurring therein, that federal and state enhancement efforts for 38 anadromous fish must be undertaken in a manner which protects Idaho's sover- 39 eignty over its water resources and prohibits contributions of water from 40 Idaho's reservoirs for flow augmentation except as authorized under state law. 41 BE IT FURTHER RESOLVED by the members of the First Regular Session of the 42 Fifty-fifth Idaho Legislature, the House of Representatives and the Senate 43 concurring therein, that the Speaker of the House of Representatives and the 44 President Pro Tempore of the Senate request Congress to enact legislation 2 1 reaffirming its deference to state law governing the allocation of water and 2 management of fish and wildlife.
STATEMENT OF PURPOSE RS09177 The purpose of this legislation is to state legislative findings and to request Congressional reaffirmation of support for Idaho's water, fish and wildlife resources.
