  1                                        AN ACT
  2    RELATING TO SEED POTATOES; AMENDING SECTION 22-501, IDAHO CODE, TO DEFINE  THE
  3        TERM  "DISTRIBUTE";  AMENDING  SECTION 22-503, IDAHO CODE, TO CLARIFY THAT
  4        ONLY CERTIFIED SEED POTATOES SHALL BE OFFERED FOR SALE, SOLD OR  DELIVERED
  5        UNDER  CONTRACT OR DISTRIBUTED INTO OR WITHIN THE STATE OF IDAHO; AND PRO-
  6        VIDING AN EFFECTIVE DATE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Section 22-501, Idaho Code, be, and the  same  is  hereby
  9    amended to read as follows:
                                                                        
 10        22-501.  DEFINITIONS. When used in this chapter:
 11        (1)  "Department"  means  the  department  of  agriculture of the state of
 12    Idaho.
 13        (2)  "Certified potatoes" means potatoes certified  according  to  chapter
 14    15,  title  22,  Idaho Code, the seed and plant certification act or a similar
 15    act of another state or country.
 16        (3)  "Director" means the director of the Idaho department of agriculture.
 17        (4)  "Distribute" means to offer for sale, sell, barter or otherwise  sup-
 18    ply potatoes or to supply, furnish or otherwise provide potatoes to a person.
 19        (5)  "Person"  means any individual, partnership, corporation, firm, asso-
 20    ciation or agent.
 21        (56)  "Potatoes" means potatoes (Solanum tuberosum) that may be  sold  for
 22    or used as seed potatoes.
                                                                        
 23        SECTION  2.  That  Section  22-503, Idaho Code, be, and the same is hereby
 24    amended to read as follows:
                                                                        
 25        22-503.  POTATOES FOR PLANTING. (1) All potatoes offered for sale, sold or
 26    delivered under contract or distributed into or within the state of Idaho  for
 27    planting  in  the  state  of Idaho by any person from any state, territory, or
 28    country shall be certified and  shall  be  accompanied  by  a  certificate  of
 29    inspection including the description of the grade, the findings of all inspec-
 30    tions of each lot of seed, noting the name and amount of disease observed, and
 31    generation  of  the  potatoes  and  shall  show that the potatoes were packed,
 32    sealed, and tagged under the certification standards of the state,  territory,
 33    or  country  in  which they were produced. The potatoes may not have a disease
 34    content that exceeds the standard for the last generation  of  certified  seed
 35    potatoes  according  to  the  Idaho rules of certification as authorized under
 36    chapter 15, title 22, Idaho Code. Potatoes  imported  from  any  other  state,
 37    country,  or territory shall be certified and also be in compliance with other
 38    applicable rules of the department pertaining to potatoes.
 39        (2)  Idaho growers shall be allowed to plant uncertified potatoes grown by
 40    them provided that they are no more than two (2) generations  from  their  own
 41    certified  parent  seed  potatoes.  After January 1, 1997, Idaho growers shall

  1    only be allowed to plant uncertified potatoes grown by them provided that they
  2    are no more than one (1) generation from their own certified parent seed pota-
  3    toes. Uncertified potatoes planted by Idaho growers as provided for under this
  4    section must comply with all testing and any other  conditions  as  set  forth
  5    under this chapter and any rules promulgated pursuant to this chapter.
                                                                        
  6        SECTION  3.  This  act shall be in full force and effect on and after July
  7    1, 2000.

                          STATEMENT  OF  PURPOSE
                            RS09364

Amend Title 22, Chapter 5, Idaho Code to provide a definition for
"distribute" and to state that only certified seed potatoes shall 
be sold or delivered under contract in Idaho. The amendment will
provide consistency with the definition of potatoes.
