  1                                        AN ACT
  2    RELATING TO ESCAPE OF PRISONERS; AMENDING SECTION 18-2505, IDAHO CODE, TO PRO-
  3        VIDE THAT ESCAPE SHALL BE DEEMED TO INCLUDE ABANDONMENT OF A JOB  SITE  OR
  4        WORK  ASSIGNMENT  WITHOUT  THE  PERMISSION  OF AN EMPLOYMENT SUPERVISOR OR
  5        OFFICER AND TO MAKE TECHNICAL  CORRECTIONS;  AND  PROVIDING  AN  EFFECTIVE
  6        DATE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section 18-2505, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        18-2505.  ESCAPE BY ONE CHARGED WITH, CONVICTED OF, OR ON PROBATION FOR  A
 11    FELONY  --  ESCAPE BY JUVENILE. (1) Every prisoner charged with, convicted of,
 12    or on probation for a felony who is confined in any jail or  prison  including
 13    the  state  penitentiary or any private prison, or who while outside the walls
 14    of such jail or prison in the proper custody of  any  officer  or  person,  or
 15    while  in  any  factory, farm or other place without the walls of such jail or
 16    prison, who escapes or attempts to escape from such officer or person, or from
 17    such jail or prison, or from such factory, farm or  other  place  without  the
 18    walls of such jail or prison, shall be guilty of a felony, and upon conviction
 19    thereof,  any  such  second term of imprisonment shall commence at the time he
 20    would otherwise have been discharged. Escape shall be deemed to include  aban-
 21    donment  of a job site or work assignment without the permission of an employ-
 22    ment supervisor or officer.
 23        (2)  Any person under the age of eighteen (18) years charged  with,  found
 24    to  have  committed, or on probation for an offense which would be a felony if
 25    committed by an adult who is confined in  a  juvenile  detention  facility  or
 26    other  secure  or nonsecure facility for juveniles and who escapes or attempts
 27    to escape from the facility or from the lawful custody of any officer or  per-
 28    son shall be subject to proceedings under chapter 5, title 20, Idaho Code, for
 29    an  offense  which would be a felony if committed by an adult. If the juvenile
 30    is or has been proceeded against as an adult, pursuant to sections  20-508  or
 31    20-509,  Idaho  Code, the juvenile shall be guilty of a felony for a violation
 32    of this section and shall be subject to adult criminal proceedings.
                                                                        
 33        SECTION 2.  This act shall be in full force and effect on and  after  July
 34    1, 2000.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE                                                            RS 09751  


The purpose of this legislation is to amend Section 18-2505, Idaho 
Code to provide that escape shall include the abandonment of a work 
site or job without permission by an employment supervisor or 
officer. This amendment was requested by Jerome County Prosecuting
Attorney John B. Lothspeich after an incident where a work release
individual escaped from a work site instead of escaping from an
officer.
