  2    RELATING TO FACILITIES NEEDS PLANNING; AMENDING CHAPTER 57,  TITLE  67,  IDAHO
  3        CODE,  BY  THE  ADDITION OF A NEW SECTION 67-5708B, IDAHO CODE, TO PROVIDE
  4        FOR FIVE YEAR FACILITIES NEEDS PLANS BY STATE AGENCIES AND TO REQUIRE  THE
  5        REPORT  OF  SUCH  NEEDS AT THEIR BUDGET HEARINGS, TO PROVIDE STANDARDS FOR
  6        THE SPACE USAGE, TO DEFINE TERMS AND TO PROVIDE RULES;  AND  PROVIDING  AN
  7        EFFECTIVE DATE.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Chapter  57,  Title 67, Idaho Code, be, and the same is
 10    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 11    ignated as Section 67-5708B, Idaho Code, and to read as follows:
                                                                        
 12        67-5708B.  FACILITIES NEEDS PLANNING. All state agencies shall prepare and
 13    maintain  a  five  (5)  year  facilities  needs plan and report such projected
 14    facilities needs at their annual budget hearings. State agencies shall prepare
 15    such five (5) year plan utilizing guidelines  for  facilities  needs  planning
 16    established  by  the  department of administration.  Any state agency that has
 17    unused, underused or available building space shall notify the  department  of
 18    administration  and  seek  opportunities  to co-occupy those facilities or any
 19    newly acquired or leased facilities with other state agencies.
 20        Each state agency shall provide a copy of its facilities needs plan report
 21    to the department of administration. The department  of  administration  shall
 22    prepare  a  five  (5)  year  statewide facilities needs plan incorporating the
 23    facilities needs plans of the state agencies and report such facilities  needs
 24    in its annual budget hearings.
 25        For purposes of this section, the term "state agency" shall mean all state
 26    departments, agencies and institutions, excluding state institutions of higher
 27    education.  For  purposes  of  this section, the term "facilities needs" shall
 28    mean the state agency's need to own,  operate  or  occupy  real  property  and
 29    improvements including administrative office buildings, structures and parking
 30    lots,  to assist it in its operation as a state agency. Facilities needs shall
 31    not include the ownership, operation or occupying of real property or improve-
 32    ments by a state agency where such ownership,  operation  or  occupying  is  a
 33    function  of  the  agency's  purpose,  such as real property and improvements,
 34    other than  administrative  office  buildings,  structures  and  parking  lots
 35    described above under the jurisdiction and control of the Idaho transportation
 36    department,  the department of fish and game, the department of parks and rec-
 37    reation and the department of lands.
 38        The department may promulgate rules and prescribe necessary procedures  to
 39    implement the provisions of this  section.
                                                                        
 40        SECTION 2.  This act shall be in full force and effect on and  after  July
 41    1, 2000.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE 
                             RS09737 

STATE BUILDINGS MANAGEMENT REFORM - This is the first in 
a package of six bills needed to improve cost-control and 
efficiency over management of state building facilities. 

Specifically, this legislation will, for the first time, 
require agencies to plan their building facility needs on 
a long-term basis. 

This legislation accomplishes the following: 

Agencies will be required to prepare a 5-year facilities 
needs plan (updated annually) and report their projected 
facilities needs to JFAC at their annual budget hearings. 

Eliminates surprises about agencies needing more floor 
space. 

Provides tighter control over building space utilization. 
Agencies are to evaluate their building facilities for 
unused, under used and available space utilizing guidelines 
promulgated by the Department of Administration. The 
objective is to insure that, where practicable, all available 
building space is identified and utilized to the maximum 
extent possible before additional building space is built 
or leased.

No negative fiscal impact. Should produce significant cost 
savings over time.
