fruits and vegetables and packages of honey to indicate those products that
originate in Idaho; to require labeling to indicate those products which do
not originate in Idaho and to indicate the state or country of origin; and
to prohibit the removal of such labeling.

2 RELATING TO MARKET LABELING OF FRUITS OR VEGETABLES OR PACKAGES OF HONEY;
3 AMENDING CHAPTER 1, TITLE 22, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
4 22-111, IDAHO CODE, TO REQUIRE LABELING PRODUCTS WHICH ORIGINATE IN IDAHO
5 TO INDICATE THEIR ORIGIN, TO REQUIRE LABELING PRODUCTS WHICH DO NOT ORIGI-
6 NATE IN IDAHO TO INDICATE THEIR ORIGIN AND PROHIBITING THE REMOVAL OF SUCH
7 LABELING.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Chapter 1, Title 22, Idaho Code, be, and the same is
10 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
11 ignated as Section 22-111, Idaho Code, and to read as follows:
12 22-111. MARKET LABELING. All producers, growers, and shippers of fresh
13 fruits and vegetables and honey in this state may mark each individual fruit
14 or vegetable or package of honey in a conspicuous place as legibly, indelibly,
15 and permanently as the nature of the fruit or vegetable or package of honey
16 will permit, and shall mark each bulk container of fruit, vegetable or package
17 of honey, in such manner as to indicate to an ultimate purchaser that the
18 product was produced in Idaho. Any fresh fruit or vegetable or package of
19 honey, including any package containing foreign honey blended with domestic
20 honey, produced in any country other than the United States or in any state of
21 the United States other than Idaho and offered for retail sale in Idaho shall
22 be similarly marked in a conspicuous place as legibly, indelibly, and perma-
23 nently as the nature of the fruit or vegetable or package of honey will per-
24 mit, in such manner as to indicate to an ultimate purchaser the country or
25 state of origin. Markings shall be done prior to delivery into Idaho. A retail
26 vendor shall label every display of fruit, vegetable or package of honey in
27 such a way that the ultimate purchaser of the commodity is able to determine
28 the state or country of origin.
29 All retail vendors engaged in the business of selling products labeled or
30 identified as to origin shall be prohibited from willfully and knowingly
31 removing such labels or identifying marks.

produce and honey sold retail within the State of Idaho.
