2 RELATING TO ELECTRIC UTILITIES; AMENDING CHAPTER 5, TITLE 61, IDAHO CODE, BY
3 THE ADDITION OF A NEW SECTION 61-541, IDAHO CODE, TO PROVIDE THAT THE GOV-
4 ERNOR MAY NEGOTIATE AND EXECUTE CONTRACTS WITH ELECTRICAL CORPORATIONS, TO
5 PROVIDE LIMITATIONS AND TO REQUIRE RATIFICATION BY THE LEGISLATURE.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Chapter 5, Title 61, Idaho Code, be, and the same is
8 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
9 ignated as Section 61-541, Idaho Code, and to read as follows:
10 61-541. GOVERNOR MAY NEGOTIATE AND CONTRACT WITH ELECTRICAL CORPORATIONS
11 -- LEGISLATIVE RATIFICATION REQUIRED. The governor of the state of Idaho or
12 his designee may negotiate and execute a contract on behalf of the state of
13 Idaho with any electrical corporation for the purpose of preserving the bene-
14 fits of the use of hydropower generation and the use of Idaho's water for the
15 benefit of its citizens, ratepayers and water right holders. Each contract
16 shall provide, among other things:
17 (1) That any successor in interest to the electric corporation shall
18 reserve and make available to Idaho citizens and ratepayers, electric energy
19 produced from the hydroelectric system within Idaho boundaries of the electric
20 corporation at the same rate per kilowatt hour that the electric corporation
21 made such electric energy available before the sale or acquisition; and
22 (2) That water rights held by the state of Idaho, its political subdivi-
23 sions and individual citizens of the state shall not be infringed.
24 Any such contract negotiated and executed by the governor or his designee
25 is void unless ratified by both houses of the legislature by adoption of a
26 concurrent resolution.
STATEMENT OF PURPOSE

The purpose of this legislation is to allow the governor of the state of Idaho to
negotiate a contract, on behalf of the state of Idaho, with any electrical corporation
for the purpose of preserving the benefits of hydro-power generation and the use
of Idaho's water for the benefit of its citizens.
