  1                                        AN ACT
  2    RELATING TO THE IDAHO PRIVATE ACTIVITY BOND CEILING ALLOCATION  ACT;  AMENDING
  3        SECTION  50-2803, IDAHO CODE, TO REVISE THE ALLOCATION FORMULA AND TO MAKE
  4        A TECHNICAL CORRECTION; AND AMENDING SECTION 50-2804, IDAHO CODE, TO  PRO-
  5        VIDE THE GOVERNOR'S EXECUTIVE ORDER SHALL ESTABLISH PRIORITIES AND TO MAKE
  6        TECHNICAL CORRECTIONS.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section 50-2803, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        50-2803.  ALLOCATION FORMULA. The  entire  state  ceiling  for  the  year,
 11    including  any  carry-forward  under  section  146(f)  of the Internal Revenue
 12    Ccode, shall be allocated by the following formula. The state ceiling shall be
 13    allocated by the state to governmental units, as needed  to  finance  specific
 14    qualified   projects and programs under the Internal Revenue Code, as amended,
 15    on the basis of the chronological order in which applications from  governmen-
 16    tal units for an allocation of the state ceiling are received effective utili-
 17    zation, need, economic impact and efficient distribution of resources through-
 18    out  the  state by the agency designated in the executive order the department
 19    of commerce. The allocation formula  established  by  this  section  shall  be
 20    implemented  and administered by the governor pursuant to the terms and provi-
 21    sions of the an executive order which shall make provisions for priorities  of
 22    projects  and  programs  based on the formula.  No qualified applicant for the
 23    state ceiling shall render decisions in the allocation formula.
                                                                        
 24        SECTION 2.  That Section 50-2804, Idaho Code, be, and the same  is  hereby
 25    amended to read as follows:
                                                                        
 26        50-2804.  AUTHORITY  OF  THE  GOVERNOR.  The  governor  is  authorized and
 27    directed to provide for the implementation and administration of  the  alloca-
 28    tion  formula  established in section 50-2803, Idaho Code, by executive order.
 29    The executive order shall: (i) establish rules and procedures  for  the  form,
 30    contents,  submission, processing, priorities and approval of applications for
 31    allocations of the state ceiling,; (ii) designate an agency for receipt, veri-
 32    fication and approval of applications and for authorization  of  allocations,;
 33    (iii)  provide  for the carry-forward of an allocation under section 146(f) of
 34    the code,; (iv) provide for the issuance to governmental units of certificates
 35    evidencing an allocation of the state ceiling,; (v) establish a period of time
 36    within  which  allocations  must  be  used,;  (vi)  provide  for  a  means  of
 37    reallocating portions of the state ceiling with  respect  to  allocations  for
 38    bonds  or  certificates that are not actually issued or are issued in a lesser
 39    amount than that portion of the state  ceiling  which  was  allocated  to  the
 40    bonds,;  and  (vii) provide for, through the establishment of rules and proce-
 41    dures or otherwise, any other matters necessary or desirable to implement  and

  1    administer  the  allocation formula and to provide for an efficient use of the
  2    state ceiling.

  1                                AMENDMENT TO SECTION 1
  2        On page 1 of the printed bill, delete lines 9 through 20 and insert:

 18        On page 1, in line 3, following "FORMULA" insert: "AND TO MAKE A TECHNICAL
 19    CORRECTION".
