2 RELATING TO DRIVER'S LICENSES, IDENTIFICATION CARDS AND FEES; AMENDING SECTION
3 49-306, IDAHO CODE, AS AMENDED BY SECTION 9, CHAPTER 81, LAWS OF 1999,
4 SECTION 1, CHAPTER 317, LAWS OF 1999, SECTION 1, CHAPTER 319, LAWS OF
5 1999, AND SECTION 2, CHAPTER 360, LAWS OF 1999, TO INCREASE A FEE AND PRO-
6 VIDE ALLOCATION TO THE EMERGENCY MEDICAL SERVICES ACCOUNT AND TO MAKE
7 TECHNICAL CORRECTIONS; AMENDING SECTION 49-306, IDAHO CODE, AS AMENDED BY
8 SENATE BILL NO. 1332, AS ENACTED BY THE SECOND REGULAR SESSION OF THE
9 FIFTY-FIFTH IDAHO LEGISLATURE, TO INCREASE FEES AND TO PROVIDE ALLOCATION
10 TO THE EMERGENCY MEDICAL SERVICES ACCOUNT; DECLARING AN EMERGENCY FOR SEC-
11 TION 1 OF THIS ACT; AND PROVIDING AN EFFECTIVE DATE FOR SECTION 2 OF THIS
12 ACT.
13 Be It Enacted by the Legislature of the State of Idaho:
14 SECTION 1. That Section 49-306, Idaho Code, as amended by Section 9,
15 Chapter 81, Laws of 1999, Section 1, Chapter 317, Laws of 1999, Section 1,
16 Chapter 319, Laws of 1999, and Section 2, Chapter 360, Laws of 1999, be, and
17 the same is hereby amended to read as follows:
18 49-306. APPLICATION FOR DRIVER'S LICENSE OR INSTRUCTION PERMIT. (1) Every
19 application for an instruction permit or for a driver's license shall be made
20 upon a form furnished by the department and shall be verified by the applicant
21 before a person authorized to administer oaths. Officers and employees of the
22 department and sheriffs and their deputies are authorized to administer the
23 oaths without charge. Every application for a permit, extension or driver's
24 license shall be accompanied by the following fee, none of which is refund-
25 able:
26 (a) Class A, B, C license with endorsements ...................... $28.50

2 (2) Every application shall state the true and full name, date of birth,
3 sex, declaration of Idaho residency, Idaho residence address and mailing
4 address, if different, of the applicant, height, weight, hair color, and eye
5 color, and the applicant's social security number as verified by the
6 applicant's social security card or by the social security administration.
7 (a) The requirement that an applicant provide a social security number as
8 verified by his social security card or by the social security administra-
9 tion shall apply only to applicants who have been assigned a social secu-
10 rity number.
11 (b) An applicant who has not been assigned a social security number
12 shall:
13 (i) Present written verification from the social security adminis-
14 tration that the applicant has not been assigned a social security
15 number; and
16 (ii) Submit a birth certificate, passport or other documentary evi-
17 dence issued by an entity other than a state or the United States;
18 and
19 (iii) Submit such proof as the department may require that the appli-
20 cant is lawfully present in the United States.
21 A driver's license or instruction permit issued on and after January 1,
22 1993, shall not contain an applicant's social security number. Applications on
23 file shall be exempt from disclosure except as provided in sections 49-202,
24 49-203, 49-203A and 49-204, Idaho Code.
25 Every application shall also state whether the applicant has previously
26 been licensed as a driver, and if so, when and by what state or country, and
27 whether a driver's license or privileges have ever been suspended, revoked,
28 denied, disqualified, cancelled or whether an application has ever been
29 refused, and if so, the date of and reason for the suspension, revocation,
30 denial, disqualification, cancellation or refusal and the applicant's oath
31 that all information is correct as signified by the applicant's signature.
32 The applicant may be required to submit proof of identity acceptable to
33 the examiner or the department and date of birth as set forth in a certified
34 copy of his birth certificate when obtainable, or another document which pro-
35 vides satisfactory evidence of a person's date of birth acceptable to the
36 examiner or the department.
37 (3) Whenever an application is received from a person previously licensed
38 in another jurisdiction, the department shall request a copy of the driver's
39 record from the other jurisdiction and shall contact the national driver reg-
40 ister. When received, the driver's record from the previous jurisdiction shall
41 become a part of the driver's record in this state with the same force and
42 effect as though entered on the driver's record in this state in the original
43 instance.
44 (4) Whenever the department receives a request for a driver's record from
45 another licensing jurisdiction, the record shall be forwarded without charge.
46 (5) The department shall contact and notify the commercial driver license
47 information system of the proposed application for a class A, B or C driver's
48 license to insure identification of the person and to obtain clearance to
49 issue the license.
50 (6) When the fees required under this section are collected by a county
51 officer, they shall be paid over to the county treasurer not less often than
52 monthly, who shall immediately:
53 (a) Deposit an amount equal to five dollars ($5.00) from each four-year
54 driver's license or instruction permit application fees, application for a
55 duplicate driver's license or permit, classification change, seasonal

1 driver's license and additional endorsement, and ten dollars ($10.00) from
2 each eight-year class D driver's license, in the current expense fund; and
3 (b) Deposit two dollars and fifty cents ($2.50) from each motorcycle
4 endorsement and motorcycle endorsement instruction permit fee in the cur-
5 rent expense fund; and
6 (c) Deposit an amount equal to three dollars ($3.00) from each fee for a
7 knowledge test in the current expense fund; and
8 (d) Deposit an amount equal to five dollars ($5.00) from each fee for a
9 motorcycle endorsement skills test in the current expense fund; provided
10 however, if a contractor administers the skills test he shall be entitled
11 to the five dollar ($5.00) fee;
12 (e) Remit the remainder to the state treasurer; and
13 (f) Deposit eleven dollars and fifty cents ($11.50) from each fee for a
14 class D skills test into the county current expense fund, unless the test
15 is administered by a department-approved contractor, in which case the
16 contractor shall be entitled to eleven dollars and fifty cents ($11.50) of
17 each fee.
18 (7) When the fees required under this section are collected by a state
19 officer or agency, they shall be paid over to the state treasurer.
20 (8) The state treasurer shall distribute the moneys received from fees
21 imposed by the provisions of this section, whether collected by a county offi-
22 cer or by a state officer or agency as follows:
23 (a) Two dollars ($2.00) of each fee for a four-year driver's license or
24 seasonal driver's license, and four dollars ($4.00) of each fee for an
25 eight-year class D driver's license, shall be deposited in the emergency
26 medical services account II created in section 39-146A, Idaho Code, and
27 four dollars ($4.00) of each such fee for a four-year class D driver's
28 license or seasonal driver's license and eight dollars ($8.00) of each fee
29 for an eight-year class D driver's license shall be deposited in the emer-
30 gency medical services account III created in section 39-146B, Idaho Code;
31 and
32 (b) Sixteen dollars and fifty cents ($16.50) of each fee for a seasonal
33 or class A, B, or C driver's license shall be deposited in the state high-
34 way account; and
35 (c) Ten dollars and fifty cents ($10.50) of each fee for a class A, B, or
36 C instruction permit or driver's license classification change shall be
37 deposited in the state highway account; and
38 (d) Four dollars ($4.00) of each fee for a class A, B, or C instruction
39 permit shall be deposited in the emergency medical services account III
40 created in section 39-146B, Idaho Code; and
41 (e) Six dollars and fifty cents ($6.50) of each fee for a duplicate sea-
42 sonal or class A, B, or C driver's license, class A, B, or C driver's
43 license extension, or additional endorsement shall be deposited in the
44 state highway account; and
45 (f) Four dollars ($4.00) of each fee for a motorcycle endorsement and
46 motorcycle endorsement instruction permit shall be deposited in the state
47 highway account; and
48 (g) Five dollars and thirty cents ($5.30) of each fee for a four-year
49 class D driver's license, and ten dollars and sixty-cents sixty cents
50 ($10.60) of each fee for an eight-year class D driver's license, shall be
51 deposited in the driver training account; and
52 (h) Seven dollars and twenty cents ($7.20) of each fee for a four-year
53 class D driver's license, and fourteen dollars and forty cents ($14.40) of
54 each fee for an eight-year class D driver's license, shall be deposited in
55 the highway distribution account; and

1 (i) Two dollars and sixty cents ($2.60) of each fee for a class D
2 instruction permit, duplicate class D license or permit, and class D
3 license extension shall be deposited in the driver training account; and
4 (j) Three dollars and ninety cents ($3.90) of each fee for a class D
5 instruction permit, duplicate class D license or permit, and class D
6 license extension shall be deposited in the highway distribution account;
7 and
8 (k) Five dollars ($5.00) of each fee for a class A, B, or C skills test
9 shall be deposited in the state highway account; and
10 (l) One dollar ($1.00) of each fee for a class A, B, C or four-year D
11 driver's license, and two dollars ($2.00) of each fee for an eight-year
12 class D driver's license, shall be deposited in the motorcycle safety pro-
13 gram fund established in section 33-4904, Idaho Code; and
14 (m) Three dollars and fifty cents ($3.50) of each fee for a class D
15 skills test shall be deposited into the state highway account.
16 (9) The contractor administering a class A, B, or C skills test shall be
17 entitled to not more than fifty dollars ($50.00) of the skills test fee. A
18 contractor administering a class A, B, or C skills test may collect an addi-
19 tional fee for the use of the contractor's vehicle for the skills test.
20 (10) Thirty-five dollars ($35.00) of each restricted driving permit shall
21 be deposited in the state highway account.
22 (11) The department may issue seasonal class B or C driver's licenses
23 that:
24 (a) Will only be valid for driving commercial vehicles that normally
25 require class B or C commercial driver's licenses;
26 (b) Will be valid for seasonal periods that begin on the date of issuance
27 and that are not to exceed one hundred eighty (180) days in a twelve (12)
28 month period;
29 (c) May only be obtained twice in a driver's lifetime;
30 (d) Are valid only within a one hundred fifty (150) mile radius of the
31 place of business or farm being serviced; and
32 (e) Will be valid only in conjunction with valid Idaho class D driver's
33 licenses.
34 (12) The department may issue seasonal class B or C driver's licenses to
35 drivers who:
36 (a) Have not violated the single license provisions of 49 CFR part 383;
37 (b) Have not had any license suspensions, revocations or cancellations;
38 (c) Have not had any convictions in any vehicle for any offense listed in
39 section 49-335(1) or 49-335(2), Idaho Code, or any one (1) serious traffic
40 offense;
41 (d) Have at least one (1) year of driving experience with a class D or
42 equivalent license in any type motor vehicle; and
43 (e) Are at least sixteen (16) years old.
44 SECTION 2. That Section 49-306, Idaho Code, as amended by Senate Bill No.
45 1332, as enacted by the Second Regular Session of the Fifty-fifth Idaho Legis-
46 lature, be, and the same is hereby amended to read as follows:
47 49-306. APPLICATION FOR DRIVER'S LICENSE OR INSTRUCTION PERMIT. (1) Every

2 this section, shall be deposited in the emergency medical services account
3 II created in section 39-146A, Idaho Code, and four dollars ($4.00) of
4 each fee charged pursuant to subsections (1)(a), (g) and (s) of this sec-
5 tion and eight dollars ($8.00) of each fee charged pursuant to subsection
6 (1)(h) of this section and three dollars ($3.00) of each fee for driver's
7 licenses pursuant to subsections (1)(b), (d) and (e) of this section, and
8 one dollar ($1.00) of each fee charged for driver's licenses pursuant to
9 subsections (1)(c) and (f) of this section shall be deposited in the emer-
10 gency medical services account III created in section 39-146B, Idaho Code;
11 and
12 (b) Sixteen dollars and fifty cents ($16.50) of each fee for a seasonal
13 or class A, B or C driver's license, and ten dollars ($10.00) of each fee
14 charged for a license pursuant to subsection (1)(b) of this section, and
15 five dollars and forty-one cents ($5.41) of each fee charged for a license
16 pursuant to subsection (1)(c) of this section shall be deposited in the
17 state highway account; and
18 (c) Ten dollars and fifty cents ($10.50) of each fee for a class A, B or
19 C instruction permit or driver's license classification change shall be
20 deposited in the state highway account; and
21 (d) Four dollars ($4.00) of each fee for a class A, B or C instruction
22 permit shall be deposited in the emergency medical services account III
23 created in section 39-146B, Idaho Code; and
24 (e) Six dollars and fifty cents ($6.50) of each fee for a duplicate sea-
25 sonal or class A, B or C driver's license, class A, B or C driver's
26 license extension, or additional endorsement shall be deposited in the
27 state highway account; and
28 (f) Four dollars ($4.00) of each fee for a motorcycle endorsement and
29 motorcycle endorsement instruction permit shall be deposited in the state
30 highway account; and
31 (g) Five dollars and thirty cents ($5.30) of each fee for a four-year
32 class D driver's license, and ten dollars and sixty cents ($10.60) of each
33 fee for an eight-year class D driver's license, and four dollars ($4.00)
34 of each fee charged for a license pursuant to subsections (1)(d) and (e)
35 of this section, and one dollar and thirty-three cents ($1.33) of each fee
36 charged for a license pursuant to subsection (1)(f) of this section shall
37 be deposited in the driver training account; and
38 (h) Seven dollars and twenty cents ($7.20) of each fee for a four-year
39 class D driver's license, and fourteen dollars and forty cents ($14.40) of
40 each fee for an eight-year class D driver's license, and six dollars
41 ($6.00) of each fee charged for a license pursuant to subsections (1)(d)
42 and (e) of this section, and four dollars and eight cents ($4.08) of each
43 fee charged for a license pursuant to subsection (1)(f) of this section
44 shall be deposited in the highway distribution account; and
45 (i) Two dollars and sixty cents ($2.60) of each fee for a class D
46 instruction permit, duplicate class D license or permit, and class D
47 license extension shall be deposited in the driver training account; and
48 (j) Three dollars and ninety cents ($3.90) of each fee for a class D
49 instruction permit, duplicate class D license or permit, and class D
50 license extension shall be deposited in the highway distribution account;
51 and
52 (k) Five dollars ($5.00) of each fee for a class A, B or C skills test
53 shall be deposited in the state highway account; and
54 (l) One dollar ($1.00) of each fee for a class A, B, C or four-year D
55 driver's license, and two dollars ($2.00) of each fee for an eight-year

1 class D driver's license, and one dollar ($1.00) of each fee charged for a
2 license pursuant to subsections (1)(b), (d) and (e) of this section, and
3 thirty-four cents (34) of each fee charged for a license pursuant to sub-
4 sections (1)(c) and (f) of this section shall be deposited in the motor-
5 cycle safety program fund established in section 33-4904, Idaho Code; and
6 (m) Three dollars and fifty cents ($3.50) of each fee for a class D
7 skills test shall be deposited into the state highway account.
8 (9) The contractor administering a class A, B or C skills test shall be
9 entitled to not more than fifty dollars ($50.00) of the skills test fee. A
10 contractor administering a class A, B or C skills test may collect an addi-
11 tional fee for the use of the contractor's vehicle for the skills test.
12 (10) Thirty-five dollars ($35.00) of each restricted driving permit shall
13 be deposited in the state highway account.
14 (11) The department may issue seasonal class B or C driver's licenses
15 that:
16 (a) Will only be valid for driving commercial vehicles that normally
17 require class B or C commercial driver's licenses;
18 (b) Will be valid for seasonal periods that begin on the date of issuance
19 and that are not to exceed one hundred eighty (180) days in a twelve (12)
20 month period;
21 (c) May only be obtained twice in a driver's lifetime;
22 (d) Are valid only within a one hundred fifty (150) mile radius of the
23 place of business or farm being serviced; and
24 (e) Will be valid only in conjunction with valid Idaho class D driver's
25 licenses.
26 (12) The department may issue seasonal class B or C driver's licenses to
27 drivers who:
28 (a) Have not violated the single license provisions of 49 CFR part 383;
29 (b) Have not had any license suspensions, revocations or cancellations;
30 (c) Have not had any convictions in any vehicle for any offense listed in
31 section 49-335(1) or (2), Idaho Code, or any one (1) serious traffic
32 offense;
33 (d) Have at least one (1) year of driving experience with a class D or
34 equivalent license in any type motor vehicle; and
35 (e) Are at least sixteen (16) years old.
36 SECTION 3. An emergency existing therefor, which emergency is hereby
37 declared to exist, Section 1 of this act shall be in full force and effect on
38 and after its passage and approval.
39 SECTION 4. Section 2 of this act shall be in full force and effect on and
40 after January 1, 2001.

42 (2) Every application shall state the true and full name, date of birth,

1 sex, declaration of Idaho residency, Idaho residence address and mailing
2 address, if different, of the applicant, height, weight, hair color, and eye
3 color, and the applicant's social security number as verified by the
4 applicant's social security card or by the social security administration.
5 (a) The requirement that an applicant provide a social security number as
6 verified by his social security card or by the social security administra-
7 tion shall apply only to applicants who have been assigned a social secu-
8 rity number.
9 (b) An applicant who has not been assigned a social security number
10 shall:
11 (i) Present written verification from the social security adminis-
12 tration that the applicant has not been assigned a social security
13 number; and
14 (ii) Submit a birth certificate, passport or other documentary evi-
15 dence issued by an entity other than a state or the United States;
16 and
17 (iii) Submit such proof as the department may require that the appli-
18 cant is lawfully present in the United States.
19 A driver's license or instruction permit issued on and after January 1,
20 1993, shall not contain an applicant's social security number. Applications on
21 file shall be exempt from disclosure except as provided in sections 49-202,
22 49-203, 49-203A and 49-204, Idaho Code.
23 Every application shall also state whether the applicant has previously
24 been licensed as a driver, and if so, when and by what state or country, and
25 whether a driver's license or privileges have ever been suspended, revoked,
26 denied, disqualified, cancelled or whether an application has ever been
27 refused, and if so, the date of and reason for the suspension, revocation,
28 denial, disqualification, cancellation or refusal and the applicant's oath
29 that all information is correct as signified by the applicant's signature.
30 The applicant may be required to submit proof of identity acceptable to
31 the examiner or the department and date of birth as set forth in a certified
32 copy of his birth certificate when obtainable, or another document which pro-
33 vides satisfactory evidence of a person's date of birth acceptable to the
34 examiner or the department.
35 (3) Whenever an application is received from a person previously licensed
36 in another jurisdiction, the department shall request a copy of the driver's
37 record from the other jurisdiction and shall contact the national driver reg-
38 ister. When received, the driver's record from the previous jurisdiction shall
39 become a part of the driver's record in this state with the same force and
40 effect as though entered on the driver's record in this state in the original
41 instance.
42 (4) Whenever the department receives a request for a driver's record from
43 another licensing jurisdiction, the record shall be forwarded without charge.
44 (5) The department shall contact and notify the commercial driver license
45 information system of the proposed application for a class A, B or C driver's
46 license to insure identification of the person and to obtain clearance to
47 issue the license.
48 (6) When the fees required under this section are collected by a county
49 officer, they shall be paid over to the county treasurer not less often than
50 monthly, who shall immediately:
51 (a) Deposit an amount equal to five dollars ($5.00) from each driver's
52 license except an eight-year class D license, or instruction permit appli-
53 cation fees, application for a duplicate driver's license or permit, clas-
54 sification change, seasonal driver's license and additional endorsement,
55 and ten dollars ($10.00) from each eight-year class D driver's license, in

1 the current expense fund; and
2 (b) Deposit two dollars and fifty cents ($2.50) from each motorcycle
3 endorsement and motorcycle endorsement instruction permit fee in the cur-
4 rent expense fund; and
5 (c) Deposit an amount equal to three dollars ($3.00) from each fee for a
6 knowledge test in the current expense fund; and
7 (d) Deposit an amount equal to five dollars ($5.00) from each fee for a
8 motorcycle endorsement skills test in the current expense fund; provided
9 however, if a contractor administers the skills test he shall be entitled
10 to the five dollar ($5.00) fee; and
11 (e) Remit the remainder to the state treasurer; and
12 (f) Deposit eleven dollars and fifty cents ($11.50) from each fee for a
13 class D skills test into the county current expense fund, unless the test
14 is administered by a department-approved contractor, in which case the
15 contractor shall be entitled to eleven dollars and fifty cents ($11.50) of
16 each fee.
17 (7) When the fees required under this section are collected by a state
18 officer or agency, they shall be paid over to the state treasurer.
19 (8) The state treasurer shall distribute the moneys received from fees
20 imposed by the provisions of this section, whether collected by a county offi-
21 cer or by a state officer or agency as follows:
22 (a) Two dollars ($2.00) of each fee for a four-year driver's license or
23 seasonal driver's license, and four dollars ($4.00) of each fee for an
24 eight-year class D driver's license, and one dollar and fifty cents
25 ($1.50) of each fee charged for driver's licenses pursuant to subsections
26 (1)(b), (d) and (e) of this section, and fifty cents (50) of each fee
27 charged for driver's licenses pursuant to subsections (1)(c) and (f) of
28 this section, shall be deposited in the emergency medical services account
29 II created in section 39-146A, Idaho Code, and four dollars ($4.00) of
30 each fee charged pursuant to subsections (1)(a), (g) and (s) of this sec-
31 tion and eight dollars ($8.00) of each fee charged pursuant to subsection
32 (1)(h) of this section and three dollars ($3.00) of each fee for driver's
33 licenses pursuant to subsections (1)(b), (d) and (e) of this section, and
34 one dollar ($1.00) of each fee charged for driver's licenses pursuant to
35 subsections (1)(c) and (f) of this section shall be deposited in the emer-
36 gency medical services account III created in section 39-146B, Idaho Code;
37 and
38 (b) Sixteen dollars and fifty cents ($16.50) of each fee for a seasonal
39 or class A, B or C driver's license, and ten dollars ($10.00) of each fee
40 charged for a license pursuant to subsection (1)(b) of this section, and
41 five dollars and forty-one cents ($5.41) of each fee charged for a license
42 pursuant to subsection (1)(c) of this section shall be deposited in the
43 state highway account; and
44 (c) Ten dollars and fifty cents ($10.50) of each fee for a class A, B or
45 C instruction permit or driver's license classification change shall be
46 deposited in the state highway account; and
47 (d) Four dollars ($4.00) of each fee for a class A, B or C instruction
48 permit shall be deposited in the emergency medical services account III
49 created in section 39-146B, Idaho Code; and
50 (e) Six dollars and fifty cents ($6.50) of each fee for a duplicate sea-
51 sonal or class A, B or C driver's license, class A, B or C driver's
52 license extension, or additional endorsement shall be deposited in the
53 state highway account; and
54 (f) Four dollars ($4.00) of each fee for a motorcycle endorsement and
55 motorcycle endorsement instruction permit shall be deposited in the state

1 highway account; and
2 (g) Five dollars and thirty cents ($5.30) of each fee for a four-year
3 class D driver's license, and ten dollars and sixty cents ($10.60) of each
4 fee for an eight-year class D driver's license, and four dollars ($4.00)
5 of each fee charged for a license pursuant to subsections (1)(d) and (e)
6 of this section, and one dollar and thirty-three cents ($1.33) of each fee
7 charged for a license pursuant to subsection (1)(f) of this section shall
8 be deposited in the driver training account; and
9 (h) Seven dollars and twenty cents ($7.20) of each fee for a four-year
10 class D driver's license, and fourteen dollars and forty cents ($14.40) of
11 each fee for an eight-year class D driver's license, and six dollars
12 ($6.00) of each fee charged for a license pursuant to subsections (1)(d)
13 and (e) of this section, and four dollars and eight cents ($4.08) of each
14 fee charged for a license pursuant to subsection (1)(f) of this section
15 shall be deposited in the highway distribution account; and
16 (i) Two dollars and sixty cents ($2.60) of each fee for a class D
17 instruction permit, duplicate class D license or permit, and class D
18 license extension shall be deposited in the driver training account; and
19 (j) Three dollars and ninety cents ($3.90) of each fee for a class D
20 instruction permit, duplicate class D license or permit, and class D
21 license extension shall be deposited in the highway distribution account;
22 and
23 (k) Five dollars ($5.00) of each fee for a class A, B or C skills test
24 shall be deposited in the state highway account; and
25 (l) One dollar ($1.00) of each fee for a class A, B, C or four-year D
26 driver's license, and two dollars ($2.00) of each fee for an eight-year
27 class D driver's license, and one dollar ($1.00) of each fee charged for a
28 license pursuant to subsections (1)(b), (d) and (e) of this section, and
29 thirty-four cents (34) of each fee charged for a license pursuant to sub-
30 sections (1)(c) and (f) of this section shall be deposited in the motor-
31 cycle safety program fund established in section 33-4904, Idaho Code; and
32 (m) Three dollars and fifty cents ($3.50) of each fee for a class D
33 skills test shall be deposited into the state highway account.
34 (9) The contractor administering a class A, B or C skills test shall be
35 entitled to not more than fifty dollars ($50.00) of the skills test fee. A
36 contractor administering a class A, B or C skills test may collect an addi-
37 tional fee for the use of the contractor's vehicle for the skills test.
38 (10) Thirty-five dollars ($35.00) of each restricted driving permit shall
39 be deposited in the state highway account.
40 (11) The department may issue seasonal class B or C driver's licenses
41 that:
42 (a) Will only be valid for driving commercial vehicles that normally
43 require class B or C commercial driver's licenses;
44 (b) Will be valid for seasonal periods that begin on the date of issuance
45 and that are not to exceed one hundred eighty (180) days in a twelve (12)
46 month period;
47 (c) May only be obtained twice in a driver's lifetime;
48 (d) Are valid only within a one hundred fifty (150) mile radius of the
49 place of business or farm being serviced; and

26 entitled to not more than fifty dollars ($50.00) of the skills test fee. A
27 contractor administering a class A, B, or C skills test may collect an addi-
28 tional fee for the use of the contractor's vehicle for the skills test.
29 (10) Thirty-five dollars ($35.00) of each restricted driving permit shall
30 be deposited in the state highway account.
31 (11) The department may issue seasonal class B or C driver's licenses
32 that:
33 (a) Will only be valid for driving commercial vehicles that normally
34 require class B or C commercial driver's licenses;
35 (b) Will be valid for seasonal periods that begin on the date of issuance
36 and that are not to exceed one hundred eighty (180) days in a twelve (12)
37 month period;
38 (c) May only be obtained twice in a driver's lifetime;
39 (d) Are valid only within a one hundred fifty (150) mile radius of the
40 place of business or farm being serviced; and
41 (e) Will be valid only in conjunction with valid Idaho class D driver's
42 licenses.
43 (12) The department may issue seasonal class B or C driver's licenses to
44 drivers who:
45 (a) Have not violated the single license provisions of 49 CFR part 383;
46 (b) Have not had any license suspensions, revocations or cancellations;
47 (c) Have not had any convictions in any vehicle for any offense listed in
48 section 49-335(1) or 49-335(2), Idaho Code, or any one (1) serious traffic
49 offense;
50 (d) Have at least one (1) year of driving experience with a class D or
51 equivalent license in any type motor vehicle; and
52 (e) Are at least sixteen (16) years old.
53 SECTION 2. That Section 49-306, Idaho Code, as amended by Senate Bill No.
54 1332, as enacted by the Second Regular Session of the Fifty-fifth Idaho Legis-

1 lature, be, and the same is hereby amended to read as follows:
2 49-306. APPLICATION FOR DRIVER'S LICENSE OR INSTRUCTION PERMIT. (1) Every
3 application for an instruction permit or for a driver's license shall be made
4 upon a form furnished by the department and shall be verified by the applicant
5 before a person authorized to administer oaths. Officers and employees of the
6 department and sheriffs and their deputies are authorized to administer the
7 oaths without charge. Every application for a permit, extension or driver's
8 license shall be accompanied by the following fee, none of which is refund-
9 able:
10 (a) Class A, B, C (4-year) license with endorsements - age 21 years and

37 (2) Every application shall state the true and full name, date of birth,
38 sex, declaration of Idaho residency, Idaho residence address and mailing
39 address, if different, of the applicant, height, weight, hair color, and eye
40 color, and the applicant's social security number as verified by the
41 applicant's social security card or by the social security administration.
42 (a) The requirement that an applicant provide a social security number as
43 verified by his social security card or by the social security administra-
44 tion shall apply only to applicants who have been assigned a social secu-
45 rity number.
46 (b) An applicant who has not been assigned a social security number
47 shall:
48 (i) Present written verification from the social security adminis-
49 tration that the applicant has not been assigned a social security
50 number; and
51 (ii) Submit a birth certificate, passport or other documentary evi-
52 dence issued by an entity other than a state or the United States;
53 and
54 (iii) Submit such proof as the department may require that the appli-

1 cant is lawfully present in the United States.
2 A driver's license or instruction permit issued on and after January 1,
3 1993, shall not contain an applicant's social security number. Applications on
4 file shall be exempt from disclosure except as provided in sections 49-202,
5 49-203, 49-203A and 49-204, Idaho Code.
6 Every application shall also state whether the applicant has previously
7 been licensed as a driver, and if so, when and by what state or country, and
8 whether a driver's license or privileges have ever been suspended, revoked,
9 denied, disqualified, cancelled or whether an application has ever been
10 refused, and if so, the date of and reason for the suspension, revocation,
11 denial, disqualification, cancellation or refusal and the applicant's oath
12 that all information is correct as signified by the applicant's signature.
13 The applicant may be required to submit proof of identity acceptable to
14 the examiner or the department and date of birth as set forth in a certified
15 copy of his birth certificate when obtainable, or another document which pro-
16 vides satisfactory evidence of a person's date of birth acceptable to the
17 examiner or the department.
18 (3) Whenever an application is received from a person previously licensed
19 in another jurisdiction, the department shall request a copy of the driver's
20 record from the other jurisdiction and shall contact the national driver reg-
21 ister. When received, the driver's record from the previous jurisdiction shall
22 become a part of the driver's record in this state with the same force and
23 effect as though entered on the driver's record in this state in the original
24 instance.
25 (4) Whenever the department receives a request for a driver's record from
26 another licensing jurisdiction, the record shall be forwarded without charge.
27 (5) The department shall contact and notify the commercial driver license
28 information system of the proposed application for a class A, B or C driver's
29 license to insure identification of the person and to obtain clearance to
30 issue the license.
31 (6) When the fees required under this section are collected by a county
32 officer, they shall be paid over to the county treasurer not less often than
33 monthly, who shall immediately:
34 (a) Deposit an amount equal to five dollars ($5.00) from each driver's
35 license except an eight-year class D license, or instruction permit appli-
36 cation fees, application for a duplicate driver's license or permit, clas-
37 sification change, seasonal driver's license and additional endorsement,
38 and ten dollars ($10.00) from each eight-year class D driver's license, in
39 the current expense fund; and
40 (b) Deposit two dollars and fifty cents ($2.50) from each motorcycle
41 endorsement and motorcycle endorsement instruction permit fee in the cur-
42 rent expense fund; and
43 (c) Deposit an amount equal to three dollars ($3.00) from each fee for a
44 knowledge test in the current expense fund; and
45 (d) Deposit an amount equal to five dollars ($5.00) from each fee for a
46 motorcycle endorsement skills test in the current expense fund; provided
47 however, if a contractor administers the skills test he shall be entitled
48 to the five dollar ($5.00) fee; and
49 (e) Remit the remainder to the state treasurer; and
50 (f) Deposit eleven dollars and fifty cents ($11.50) from each fee for a
51 class D skills test into the county current expense fund, unless the test
52 is administered by a department-approved contractor, in which case the
53 contractor shall be entitled to eleven dollars and fifty cents ($11.50) of
54 each fee.
55 (7) When the fees required under this section are collected by a state

1 officer or agency, they shall be paid over to the state treasurer.
2 (8) The state treasurer shall distribute the moneys received from fees
3 imposed by the provisions of this section, whether collected by a county offi-
4 cer or by a state officer or agency as follows:
5 (a) Two dollars ($2.00) of each fee for a four-year driver's license or
6 seasonal driver's license, and four dollars ($4.00) of each fee for an
7 eight-year class D driver's license, and one dollar and fifty cents
8 ($1.50) of each fee charged for driver's licenses pursuant to subsections
9 (1)(b), (d) and (e) of this section, and fifty cents (50) of each fee
10 charged for driver's licenses pursuant to subsections (1)(c) and (f) of
11 this section, shall be deposited in the emergency medical services account
12 II created in section 39-146A, Idaho Code, and four dollars ($4.00) of
13 each fee charged pursuant to subsections (1)(a), (g) and (s) of this sec-
14 tion and eight dollars ($8.00) of each fee charged pursuant to subsection
15 (1)(h) of this section and three dollars ($3.00) of each fee for driver's
16 licenses pursuant to subsections (1)(b), (d) and (e) of this section, and
17 one dollar ($1.00) of each fee charged for driver's licenses pursuant to
18 subsections (1)(c) and (f) of this section shall be deposited in the emer-
19 gency medical services account III created in section 39-146B, Idaho Code;
20 and
21 (b) Sixteen dollars and fifty cents ($16.50) of each fee for a seasonal
22 or class A, B or C driver's license, and ten dollars ($10.00) of each fee
23 charged for a license pursuant to subsection (1)(b) of this section, and
24 five dollars and forty-one cents ($5.41) of each fee charged for a license
25 pursuant to subsection (1)(c) of this section shall be deposited in the
26 state highway account; and
27 (c) Ten dollars and fifty cents ($10.50) of each fee for a class A, B or
28 C instruction permit or driver's license classification change shall be
29 deposited in the state highway account; and
30 (d) Four dollars ($4.00) of each fee for a class A, B or C instruction
31 permit shall be deposited in the emergency medical services account III
32 created in section 39-146B, Idaho Code; and
33 (e) Six dollars and fifty cents ($6.50) of each fee for a duplicate sea-
34 sonal or class A, B or C driver's license, class A, B or C driver's
35 license extension, or additional endorsement shall be deposited in the
36 state highway account; and
37 (f) Four dollars ($4.00) of each fee for a motorcycle endorsement and
38 motorcycle endorsement instruction permit shall be deposited in the state
39 highway account; and
40 (g) Five dollars and thirty cents ($5.30) of each fee for a four-year
41 class D driver's license, and ten dollars and sixty cents ($10.60) of each
42 fee for an eight-year class D driver's license, and four dollars ($4.00)
43 of each fee charged for a license pursuant to subsections (1)(d) and (e)
44 of this section, and one dollar and thirty-three cents ($1.33) of each fee
45 charged for a license pursuant to subsection (1)(f) of this section shall
46 be deposited in the driver training account; and
47 (h) Seven dollars and twenty cents ($7.20) of each fee for a four-year
48 class D driver's license, and fourteen dollars and forty cents ($14.40) of
49 each fee for an eight-year class D driver's license, and six dollars
50 ($6.00) of each fee charged for a license pursuant to subsections (1)(d)
51 and (e) of this section, and four dollars and eight cents ($4.08) of each
52 fee charged for a license pursuant to subsection (1)(f) of this section
53 shall be deposited in the highway distribution account; and
54 (i) Two dollars and sixty cents ($2.60) of each fee for a class D
55 instruction permit, duplicate class D license or permit, and class D

1 license extension shall be deposited in the driver training account; and
2 (j) Three dollars and ninety cents ($3.90) of each fee for a class D
3 instruction permit, duplicate class D license or permit, and class D
4 license extension shall be deposited in the highway distribution account;
5 and
6 (k) Five dollars ($5.00) of each fee for a class A, B or C skills test
7 shall be deposited in the state highway account; and
8 (l) One dollar ($1.00) of each fee for a class A, B, C or four-year D
9 driver's license, and two dollars ($2.00) of each fee for an eight-year
10 class D driver's license, and one dollar ($1.00) of each fee charged for a
11 license pursuant to subsections (1)(b), (d) and (e) of this section, and
12 thirty-four cents (34) of each fee charged for a license pursuant to sub-
13 sections (1)(c) and (f) of this section shall be deposited in the motor-
14 cycle safety program fund established in section 33-4904, Idaho Code; and
15 (m) Three dollars and fifty cents ($3.50) of each fee for a class D
16 skills test shall be deposited into the state highway account.
17 (9) The contractor administering a class A, B or C skills test shall be
18 entitled to not more than fifty dollars ($50.00) of the skills test fee. A
19 contractor administering a class A, B or C skills test may collect an addi-
20 tional fee for the use of the contractor's vehicle for the skills test.
21 (10) Thirty-five dollars ($35.00) of each restricted driving permit shall
22 be deposited in the state highway account.

49 after January 1, 2001.

To clean up code and amend the code to implement the Emergency Medical
Services Account III fee, passed in 1999, to be $4.00 for a 4 year class D drivers
license and $8.00 for an 8 year license. The fee was inadvertently not doubled on
the 8 year license when it was passed. To activate an emergency clause.
FISCAL NOTE
Emergency Medical Services Account III will be reduced one half of the amount
needed to fund the ambulances and medical equipment.
