  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE DEPARTMENT  OF  COMMERCE  FOR  FISCAL  YEAR  2001;
  3        DIRECTING  THE  STATE  CONTROLLER  TO TRANSFER CERTAIN FUNDS AS REQUESTED;
  4        TRANSFERRING CERTAIN MONEYS TO THE HISPANIC  CULTURAL  CENTER  FUND,  WITH
  5        EXPENDITURES  SUBJECT  TO  CERTAIN  CONDITIONS; AND LIMITING THE NUMBER OF
  6        FULL-TIME EQUIVALENT POSITIONS.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  There is hereby appropriated to the Department of Commerce the
  9    following amounts from the listed funds to be expended according to designated
 10    expense classes for the period July 1, 2000, through June 30, 2001:

 31        SECTION 2.  The State Controller shall transfer up to  $124,100  from  the
 32    INEEL  Settlement  Fund  to the Department of Commerce's Miscellaneous Revenue
 33    Fund, as requested by the Department of Commerce.
                                                                        
 34        SECTION 3.  The State Controller shall transfer  $50,000  of  the  General
 35    Fund  appropriation  for Trustee and Benefit Payments in Section 1 of this act
 36    to the Hispanic Cultural Center Fund. These moneys shall not be expended  from
 37    the  Hispanic  Cultural  Center  Fund  until $2,900,000 has been received from
 38    nonstate sources to construct  the  Hispanic  Cultural  Center,  and  specific
 39    authorization has been granted by the Joint Finance-Appropriations Committee.
                                                                        
 40        SECTION 4.  In accordance with Section 67-3519, Idaho Code, the Department
 41    of  Commerce  is  authorized no more than fifty-four (54) full-time equivalent

  1    positions at any point during the period July 1, 2000, through June 30,  2001,
  2    for the program specified in Section 1 of this act, unless specifically autho-
  3    rized  by  the  Governor.  The  Joint Finance-Appropriations Committee will be
  4    notified promptly of any increased positions so authorized.

Statement of Purpose

This is the Fiscal Year 2001 appropriation for the Department of Commerce. This budget includes two enhancements. The first provides $250,000 in ongoing General Fund money for promoting rural development, Idaho exports, and a campaign to improve Idaho’s image. The second enhancement provides $50,000 in one-time General Fund money to help fund the construction of a Hispanic Cultural Center in Canyon County. Section 3 of the bill contains legislative intent language that guides the disbursement of these funds.
