  1                                        AN ACT
  2    APPROPRIATING MONEYS FROM THE IDAHO MILLENNIUM INCOME FUND TO THE STATE  TREA-
  3        SURER  FOR  THE  PURPOSES  SPECIFIED  FOR  FISCAL YEAR 2001; APPROPRIATING
  4        MONEYS TO VARIOUS PROGRAMS; PROVIDING  LEGISLATIVE  INTENT  TO  THE  CATA-
  5        STROPHIC  HEALTH  CARE  COST PROGRAM BOARD REGARDING CERTAIN EXPENDITURES;
  6        AND PROVIDING LEGISLATIVE INTENT REGARDING  THE  ALLOCATION  OF  AVAILABLE
  7        FUNDS.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  There  is  hereby  appropriated  $2,305,000  from  the  Idaho
 10    Millennium  Income  Fund to the State Treasurer to be expended for trustee and
 11    benefit payments as specified in Section 2 of this act for the period July  1,
 12    2000, through June 30, 2001.
                                                                        
 13        SECTION  2.  Of the amount appropriated to the State Treasurer for trustee
 14    and benefit payments in Section 1 of this act, there  is  hereby  appropriated
 15    from the Idaho Millennium Income Fund to the following programs for the period
 16    July 1, 2000, through June 30, 2001:
                                                                        
 17        (a)  $100,000  for  the Legislature for deposit in the Legislative Account
 18        for Millennium Fund Legislative Subcommittee technical support services.
                                                                        
 19        (b)  $200,000 for the Bureau of Health  Promotion  in  the  Department  of
 20        Health and Welfare to collect baseline data and develop detailed recommen-
 21        dations  for  a  comprehensive  tobacco use and substance abuse prevention
 22        program.
                                                                        
 23        (c)  $500,000 for the Public Health Districts  to  implement  tobacco  use
 24        cessation  programs statewide through the Public Health Districts of Idaho
 25        and other nonprofit entities such as hospitals, primary care  clinics  and
 26        volunteer  organizations.  The  tobacco  use  cessation programs should be
 27        available to any Idaho citizen, with primary emphasis on youth  and  preg-
 28        nant  women.  The program shall include strong evaluation measures includ-
 29        ing, but not limited to, the number of programs funded, the number of par-
 30        ticipants, and quit rates.
                                                                        
 31        (d)  $735,000 for the Catastrophic Health Care Cost Program  for  tobacco-
 32        related  cancer  and respiratory disease treatment, by way of reducing the
 33        county deductible payment pursuant to Section 3 of this act.
                                                                        
 34        (e)  $500,000 for the Bureau of Health  Promotion  in  the  Department  of
 35        Health  and  Welfare for targeted tobacco counter-marketing programs, spe-
 36        cific to Idaho, and to be matched by private industry funds on at least  a
 37        one-to-one basis.

  1        (f)  $170,000  for the Idaho Supreme Court for youth courts and community-
  2        based programs in the judicial districts that address tobacco and/or  sub-
  3        stance abuse.
                                                                        
  4        (g)  $100,000  for the Children's Trust Account Board in the Department of
  5        Health and Welfare to provide a Youth-Asset Building Summit and to network
  6        Idaho communities.
                                                                        
  7                                                          GRAND TOTAL:  $2,305,000
                                                                        
  8        SECTION 3.  It is legislative intent that  the  Catastrophic  Health  Care
  9    Cost  Program  Board use the funds appropriated in Section 2(d) of this act to
 10    temporarily reduce the $10,000 deductible paid by counties for  the  costs  of
 11    caring  for indigent persons with tobacco-related cancers and respiratory dis-
 12    eases. The Catastrophic Health Care Cost Program Board shall  be  vested  with
 13    the  authority  to  define  and  determine which cases qualify for the reduced
 14    county deductible, subject to the provisions of this section.  Notwithstanding
 15    the  provisions  of  Chapter 35, Title 31, Idaho Code, the Catastrophic Health
 16    Care Cost Program Board is hereby granted the authority to enact these  reduc-
 17    tions  for  the  period July 1, 2000, through June 30, 2001, provided that the
 18    additional fiscal impact of these reductions on the Catastrophic  Health  Care
 19    Cost  Program shall not exceed the amount appropriated in Section 2(d) of this
 20    act.
                                                                        
 21        SECTION 4.  It is legislative intent that if the total  amount  of  moneys
 22    appropriated  in  Section  2  of this act are not available for appropriation,
 23    then the State Treasurer shall allocate such funds as  are  available  to  the
 24    recipients  listed in Section 2 of this act, in the proportion that the amount
 25    each recipient's appropriation bears to the total amount appropriated.

This is the Fiscal Year 2001 appropriation for the Idaho Millennium Fund, which is located in the State Treasurer’s Office. All appropriations from this fund are on a one-time basis.

This appropriation funds seven projects. The first two provide funds to conduct research and develop plans for how best to combat tobacco use and substance abuse. The third provides funding to implement tobacco cessation programs throughout Idaho. The fourth provides relief to counties for the cost of caring for indigent persons with tobacco-related cancers and respiratory diseases. The fifth funds a tobacco counter-marketing program, with funds to be matched by private sector contributions. The sixth provides funding for Youth Courts and community-based programs. The seventh funds a Youth-Asset Building Summit.

Section 3 grants the Catastrophic Health Care Cost Program Board the authority necessary to implement the $735,000 cost reduction for county indigent health care costs. Section 4 provides a mechanism for allocating the distribution of Millennium Fund earnings.
