HOUSE CONCURRENT RESOLUTION NO. 46

1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND EXPRESSING SUPPORT FOR THE ESTABLISH-
3 MENT AND PERPETUAL MAINTENANCE AND OPERATION OF AN IDAHO STATE VETERANS
4 CEMETERY.
5 Be It Resolved by the Legislature of the State of Idaho:
6 WHEREAS, Idaho is the only state in the nation without a state or
7 federally-supported cemetery for its wartime veterans; and
8 WHEREAS, thirty-two states currently have, or are planning, the construc-
9 tion of a state cemetery; and
10 WHEREAS, Idaho World War II veterans are dying at an alarming rate and
11 deserve to be laid to rest in a field of honor befitting their sacrifices; and
12 WHEREAS, the federal government will commit funding for one hundred per-
13 cent of planning, construction and support equipment costs for the establish-
14 ment of a state veterans cemetery for Idaho; and
15 WHEREAS, the state of Idaho is obligated to provide the land and perpetual
16 funding for operation and maintenance of the cemetery; and
17 WHEREAS, a land donor has committed sufficient acreage in the Hidden Hol-
18 low subdivision of Boise, Idaho, located north of Dry Creek Cemetery, west of
19 old Highway 55; and for the purposes of applicable taxes, the real property,
20 when accepted by the state of Idaho, shall be considered a gift with the
21 understanding that the property shall revert to the donor if a veterans ceme-
22 tery is not constructed on such property; and
23 WHEREAS, funding for the continued operation and maintenance of the state
24 veterans cemetery shall be derived from veterans motor vehicle license plates;
25 and
26 WHEREAS, preliminary estimates gained through proposed bids for operation
27 and maintenance of the cemetery are less than one hundred thousand dollars
28 annually.
29 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
30 sion of the Fifty-fifth Idaho Legislature, the House of Representatives and
31 the Senate concurring therein, that we support the establishment and perpetual
32 maintenance and operation of an Idaho state veterans cemetery.
33 BE IT FURTHER RESOLVED that it is the intent of the Legislature that two
34 hundred thousand dollars be appropriated for fiscal year 2001 for cemetery
35 design, and that such amount be reimbursed to the state of Idaho by the fed-
36 eral Veterans Administration.
37 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa-
38 tives be, and she is hereby authorized and directed to forward a copy of this
39 resolution to the President of the Senate and the Speaker of the House of Rep-
40 resentatives of Congress, and the congressional delegation representing the
41 state of Idaho in the Congress of the United States.

STATEMENT OF PURPOSE

A concurrent resolution stating finding of the legislature and expressing support
for the establishment and perpetual maintenance and operation of an Idaho State
Veterans Cemetery.
FISCAL IMPACT
This legislation has no impact on the taxpayers of Idaho. The initial startup costs
of $200,000 provided for in the Governor's budget request for the Department of
Health and Welfare are identified within the Division of Veteran Services. These
funds will be expended to develop a preliminary design for the cemetery to be
reviewed by the Veterans Administration. When the design review is accepted by
the Veterans Administration, those funds will be reimbursed to the State of Idaho
general fund.
