SENATE BILL NO. 1288, As Amended

1 AN ACT
2 RELATING TO THE EDUCATION OF INMATES UNDER THE JURISDICTION OF THE DEPARTMENT
3 OF CORRECTION; AMENDING SECTION 33-123, IDAHO CODE, TO REVISE HOW EDUCA-
4 TIONAL COURSES FOR INMATES UNDER THE JURISDICTION OF THE DEPARTMENT OF
5 CORRECTION WILL BE HANDLED AND IMPLEMENTED AND TO PROVIDE A REPORT TO THE
6 2001 LEGISLATURE; AND PROVIDING AN EFFECTIVE DATE.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Section 33-123, Idaho Code, be, and the same is hereby
9 amended to read as follows:
10 33-123. EDUCATION FOR INMATES UNDER JURISDICTION OF DEPARTMENT OF CORREC-
11 TION. The state board, in cooperation with the state board of correction,
12 shall have prepared suitable courses of study, including professional-
13 technical training, for prisoners held under the jurisdiction of the depart-
14 ment of correction, and the state board of correction education, in coopera-
15 tion with the state board of correction, shall make arrangements carrying into
16 effect implement all provisions for the education of prisoners who are under
17 the jurisdiction of the department of correction to the extent possible within
18 the limits of moneys appropriated by the state legislature. Such educational
19 opportunities shall be limited to those inmates who have a need, such need to
20 be determined by the staff of the department of correction, and can benefit
21 from training, and those inmates whose degree of custody classification allows
22 participation in the classroom environment provided. Such educational opportu-
23 nities may be limited to those inmates who have a need to be determined by the
24 staff of the state board of education. For those inmates whose degree of cus-
25 tody classification does not allow participation in the classroom environment,
26 other opportunities shall be explored and offered as diagnosed cooperatively
27 between the board of education and the board of correction. Both boards shall
28 prepare a joint report and present it to the legislature regarding the results
29 of this effort at the 2001 regular legislative session.
30 SECTION 2. This act shall be in full force and effect on and after July
31 1, 2000.

1 AMENDMENTS TO SECTION 1
2 On page 1 of the printed bill, delete line 12 and insert: "TION. The state
3 board, in cooperation with the state board of correction,"; delete line 15 and
4 insert: "ment of correction, and the state board of correction education, in
5 cooperation with the state board of correction, shall make"; in line 23 fol-
6 lowing "vided." insert: "Such educational opportunities may be limited to
7 those inmates who have a need to be determined by the staff of the state board
8 of education. For those inmates whose degree of custody classification does
9 not allow participation in the classroom environment, other opportunities
10 shall be explored and offered as diagnosed cooperatively between the board of

14 CORRECTION TO TITLE
15 On page 1, delete lines 3 through 7 and insert: "OF CORRECTION; AMENDING
16 SECTION 33-123, IDAHO CODE, TO REVISE HOW EDUCATIONAL COURSES FOR INMATES
17 UNDER THE JURISDICTION OF THE DEPARTMENT OF CORRECTION WILL BE HANDLED AND
18 IMPLEMENTED AND TO PROVIDE A REPORT TO THE 2001 LEGISLATURE; AND PROVIDING AN
19 EFFECTIVE DATE.".
Statement of Purpose

The purpose of this legislation is to provide that the State
Board of Education shall implement all provisions for the
education of prisoners under the jurisdiction of the Department
of Correction to the extent possible within limits of moneys
appropriated by the State Legislature.
FISCAL IMPACT
There will be minimal impact to the general fund since this
legislation will not result in any new programs, but simply
transfers authority for education programs from the Department
of Correction to the State Board of Education.
