2 RELATING TO RECORDS EXEMPT FROM DISCLOSURE; AMENDING SECTION 9-340F, IDAHO
3 CODE, TO PROVIDE THAT DRAFT CONGRESSIONAL OR LEGISLATIVE REDISTRICTING
4 PLANS PREPARED FOR MEMBERS OF THE COMMISSION FOR REAPPORTIONMENT ARE
5 EXEMPT FROM DISCLOSURE AND PROVIDING FOR DISCLOSURE; AND PROVIDING AN
6 EFFECTIVE DATE.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Section 9-340F, Idaho Code, be, and the same is hereby
9 amended to read as follows:
10 9-340F. RECORDS EXEMPT FROM DISCLOSURE -- DRAFT LEGISLATION AND SUPPORT-
11 ING MATERIALS, TAX COMMISSION, PETROLEUM CLEAN WATER TRUST FUND. The following
12 records are exempt from disclosure:
13 (1) Records consisting of draft legislation and documents specifically
14 related to such draft legislation or research requests submitted to the legis-
15 lative services office by a member of the Idaho legislature for the purpose of
16 placing such draft legislation into a form suitable for introduction as offi-
17 cial proposed legislation of the legislature of the state of Idaho, unless the
18 individual legislator having submitted or requested such records or research
19 agrees to waive the provisions of confidentiality provided by this subsection.
20 (2) All papers, physical and electronic records and correspondence or
21 other supporting materials comprising the work papers in the possession of the
22 legislative services office or the director of legislative performance evalua-
23 tions prior to release of the related final audit and all other records or
24 materials in the possession of the legislative services office or the director
25 of legislative performance evaluations that would otherwise be confidential
26 or exempt from disclosure.
27 (3) Records consisting of draft congressional and legislative redistrict-
28 ing plans and documents specifically related to such draft redistricting plans
29 or research requests submitted to the commission staff by a member of the com-
30 mission for reapportionment for the purpose of placing such draft redistrict-
31 ing plan into form suitable for presentation to the full membership of the
32 commission, unless the individual commission member having submitted or
33 requested such plans or research agrees to waive the provisions of confidenti-
34 ality provided by this subsection.
35 (4) Records that identify the method by which the Idaho state tax com-
36 mission selects tax returns for audit review.
37 (45) Underwriting and claims records of the Idaho petroleum clean water
38 trust fund obtained pursuant to section 41-4904, 41-4908, 41-4910A, 41-4911 or
39 41-4911A, Idaho Code. Provided however, that this subsection shall not prevent
40 the Idaho petroleum clean water trust fund's submittal to the Idaho department
41 of health and welfare, division of environmental quality, or other regulatory
42 agencies of information necessary to satisfy an insured's corrective action
43 requirement under applicable federal or state standards in the event of a

1 release into the environment from a petroleum storage tank; and provided fur-
2 ther that nothing in this subsection shall prevent the Idaho petroleum clean
3 water trust fund from providing auditing, reporting, or actuarial information
4 as otherwise required of it pursuant to section 41-4918, 41-4924A, 41-4931,
5 41-4933, 41-4935, 41-4940 or 41-4941, Idaho Code.
6 SECTION 2. This act shall be in full force and effect on and after July
7 1, 2000.
STATEMENT OF PURPOSE
RS 09590
When the Idaho Constitution was amended to create a commission for
reapportionment, it was necessary to adopt statutes to describe the
way the commission would conduct its activities. Overlooked at the
time, was a need to clarify the public record laws with respect to
draft redistricting plans adopted and research requests prepared for
presentation to the commission, as such provisions exist for draft
legislation. This bill would exempt such plans or documents and
research requests from disclosure, using the same language that
exists in the code for draft legislation.
