1 AN ACT
2 STATING THE FINDINGS OF THE LEGISLATURE AND PROVIDING THAT THE NAME OF THE
3 DEPARTMENT OF HEALTH AND WELFARE SHALL BE CHANGED TO THE DEPARTMENT OF
4 HEALTH AND HUMAN SERVICES; AMENDING SECTIONS 67-2402 AND 67-2406, IDAHO
5 CODE, TO PROVIDE A NAME CHANGE; AND PROVIDING AN EFFECTIVE DATE.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. It is the finding of the Legislature that in order to accu-
8 rately reflect and represent the responsibilities of that agency of state gov-
9 ernment now designated the Department of Health and Welfare, it is appropriate
10 that the agency name be changed and therefor, the agency shall hereafter be
11 the Department of Health and Human Services. Whenever in the Idaho Code or
12 elsewhere, reference is made to the Department of Health and Welfare it shall
13 mean and hereafter be, the Department of Health and Human Services.
14 SECTION 2. That Section 67-2402, Idaho Code, be, and the same is hereby
15 amended to read as follows:
16 67-2402. STRUCTURE OF THE EXECUTIVE BRANCH OF IDAHO STATE GOVERNMENT. (1)
17 Pursuant to section 20, article IV, Idaho constitution, all executive and
18 administrative offices, agencies, and instrumentalities of the executive
19 department of state, except for those assigned to the elected constitutional
20 officers, are allocated among and within the following departments:
21 Department of administration
22 Department of agriculture
23 Department of commerce
24 Department of correction
25 Department of labor
26 Department of finance
27 Department of fish and game
28 Department of health and welfare human services
29 Department of insurance
30 Department of juvenile corrections
31 Idaho transportation department
32 Industrial commission
33 Department of lands
34 Department of law enforcement
35 Department of parks and recreation
36 Department of revenue and taxation
37 Department of self-governing agencies
38 Department of water resources
39 State board of education
40 The public school districts of Idaho, having condemnation authority, shall
41 be considered civil departments of state government for the purpose of and
42 limited to the purchase of state endowment land at appraised prices.

1 (2) The governor, lieutenant governor, secretary of state, state control-
2 ler, state treasurer, attorney general and superintendent of public instruc-
3 tion each heads a constitutional office.
4 (3) For its internal structure, unless specifically provided otherwise,
5 each department shall adhere to the following standard terms:
6 (a) The principal unit of a department is a division. Each division shall
7 be headed by an administrator. The administrator of any division shall be
8 exempt from the provisions of chapter 53, title 67, Idaho Code.
9 (b) The principal unit of a division is a bureau. Each bureau shall be
10 headed by a chief.
11 (c) The principal unit of a bureau is a section. Each section shall be
12 headed by a supervisor.
13 SECTION 3. That Section 67-2406, Idaho Code, be, and the same is hereby
14 amended to read as follows:
15 67-2406. DIRECTORS OF DEPARTMENTS ENUMERATED. The following department
16 directors are created:
17 Director, department of administration
18 Director, department of agriculture
19 Director, department of commerce
20 Director, department of correction
21 Director, department of labor
22 Director, department of finance
23 Director, department of fish and game
24 Director, department of health and welfare human services
25 Director, department of insurance
26 Director, department of juvenile corrections
27 Director, Idaho transportation department
28 Director, department of lands
29 Director, department of law enforcement
30 Director, department of parks and recreation
31 Director, department of water resources.
32 SECTION 4. This act shall be in full force and effect on and after July
33 1, 2000.
STATEMENT OF PURPOSE

This legislation amends Sections 67-2402 and 67-2046, Idaho Code,
that shall change the name of the Department of Health and Welfare
to the Department of Health and Human Service and provides an
effective date. The Department provides a broad based Human
Service delivery system, the Welfare services have been reduced
to the point it is misleading to the public to have "Welfare" in
the Department's name. Welfare no longer fits within the vision
and the direction the Department desires to go in the future. The
Department of Health and Human Service is a commonly used name
throughout the U.S. for comparable agencies.
