BY LOCAL GOVERNMENT AND TAXATION COMMITTEE
1 AN ACT
2 RELATING TO BUDGET HEARINGS; AMENDING SECTION 63-802A, IDAHO CODE, TO PROVIDE
3 THAT IF NO BUDGET HEARING IS STATUTORILY REQUIRED, THE COUNTY CLERK SHALL
4 BE SO NOTIFIED; DECLARING AN EMERGENCY AND PROVIDING RETROACTIVE APPLICA-
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 63-802A, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 63-802A. NOTICE OF BUDGET HEARING. Not later than April 30 of each year,
10 each taxing district shall set and notify the county clerk of the date and
11 location set for the budget hearing of the district. If no budget hearing will
12 be held is statutorily required, the county clerk shall be so notified.
13 SECTION 2. An emergency existing therefor, which emergency is hereby
14 declared to exist, this act shall be in full force and effect on and after its
15 passage and approval, and retroactively to January 1, 2000.
STATEMENT OF PURPOSE
The purpose of this legislation is to provide that if no
budget hearing is statutorily required, pertaining to the
April 30 deadline regarding taxing districts, then the
county clerk should be so notified that there will not
be any hearing.
There is no anticipated fiscal impact.
