SENATE BILL NO. 1340
BY LOCAL GOVERNMENT AND TAXATION COMMITTEE
1 AN ACT
2 RELATING TO COMMUNITY SERVICE FEES; AMENDING SECTION 31-3201C, IDAHO CODE, TO
3 PROVIDE THAT COMMUNITY SERVICE FEES SHALL BE PAID TO THE DISTRICT COURT
4 AND DEPOSITED IN THE COUNTY TREASURY FOR PAYMENT TO THE STATE INSURANCE
5 FUND; AND PROVIDING AN EFFECTIVE DATE.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 31-3201C, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 31-3201C. COMMUNITY SERVICE FEE. The court shall charge a fee of sixty
10 cents (60) per hour of community service to be remitted to the state insur-
11 ance fund for purposes of providing worker's compensation insurance for per-
12 sons performing community service. This per hour fee shall be paid by each
13 person found guilty of any felony or misdemeanor and community service is pro-
14 vided as part of the sanction or as a condition of a withheld judgment or pro-
15 bation. The court may waive such fee if it determines the person is indigent
16 and unable to pay such fee. Such fees shall be in addition to all other fines
17 and fees levied. Such fees shall be paid to the district court and deposited
18 in the county treasurer who shall pay such fees treasury for payment to the
19 state insurance fund. with their worker's compensation premium.
20 SECTION 2. This act shall be in full force and effect on and after July
21 1, 2000.
STATEMENT OF PURPOSE
RS09722
The purpose of this legislation is to provide that Community
Service Fees shall be paid to the District Court and deposited
in the State Insurance Fund. Currently, these fees are paid
to the county treasurer who often does not have records on
the amount of money due. The District Court has these records
and can ensure that the correct amount is collected.
FISCAL NOTE
There will be no impact to the General Fund or to the taxpayers.
