  1                                        AN ACT
  2    RELATING TO  SCHOOL  ELECTIONS;  AMENDING  SECTION  33-502A,  IDAHO  CODE,  TO
  3        INCREASE THE TIME PRIOR TO AN ELECTION WHEN A WRITE-IN CANDIDATE MUST FILE
  4        A DECLARATION OF CANDIDACY; AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section 33-502A, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        33-502A.  DECLARATION OF INTENT FOR WRITE-IN CANDIDATES. No write-in  vote
  9    for  school  district  trustee  in a school district election shall be counted
 10    unless a declaration of intent has  been  filed  indicating  that  the  person
 11    desires  the  office  and  is legally qualified to assume the duties of school
 12    trustee if elected. The declaration of intent shall be filed with  the  school
 13    district  clerk. Such declaration of intent shall be filed not later than five
 14    fourteen (514) days before the day of election.
                                                                        
 15        SECTION 2.  This act shall be in full force and effect on and  after  July
 16    1, 2000.

Statement of Purpose / Fiscal Impact




                      STATEMENT OF PURPOSE
                            RS 09701 
     The purpose of this legislation is to extend the time period requirement for school district
trustee election write-in candidate filing from 5 to 14 days. 
     This would allow school district staff a more realistic time frame to prepare for the
election.





 
                          FISCAL NOTE 

This proposal would not effect the state's general fund. It is projected that savings in staff costs
and overtime, printing and advertising costs would result for the school district budget.
