                       SENATE BILL NO. 1397, As Amended in the House

  1                                        AN ACT
  2    RELATING TO SETTING THE UNITED STATES  FLAG  AND  STATE  FLAG  AT  HALF-STAFF;
  3        AMENDING CHAPTER 8, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
  4        67-818,  IDAHO  CODE,  TO PROVIDE THAT FLAGS AT STATE AND LOCAL GOVERNMENT
  5        BUILDINGS SHALL BE FLOWN AT HALF-STAFF FOR DEATHS IN THE LINE OF DUTY  FOR
  6        POLICE, FIREFIGHTERS, PARAMEDICS OR EMTS; AND DECLARING AN EMERGENCY.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Chapter  8,  Title  67, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 67-818, Idaho Code, and to read as follows:
                                                                        
 11        67-818.  FLAGS  FLOWN  AT  HALF-STAFF -- DEATH IN LINE OF DUTY FOR POLICE,
 12    FIREFIGHTERS, PARAMEDICS OR EMTS. The governor, upon timely  notification  and
 13    verification  of  the death of a federal, state or local law enforcement offi-
 14    cer, firefighter, paramedic or emergency medical technician who is employed or
 15    volunteering for an agency in the state of Idaho and who died in the  line  of
 16    duty,  shall  direct  that the flag of the United States and the state flag be
 17    flown at half-staff, from the time of notification to the governor  until  the
 18    day following the memorial service, at the state capitol building and at other
 19    state  and local government buildings. The flags shall be flown upon an exist-
 20    ing flagstaff or flagstaffs or, at the option of the governor, a flagstaff  or
 21    flagstaffs  erected  at an appropriate site, after consultation with organiza-
 22    tions representing law  enforcement  officers,   firefighters,  paramedics  or
 23    emergency  medical  technicians regarding the location and design of the flag-
 24    staff or flagstaffs. The flag flown over the capitol building in honor of  the
 25    deceased shall be presented to the family.
                                                                        
 26        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 27    declared to exist, this act shall be in full force and effect on and after its
 28    passage and approval.

  1                                AMENDMENT TO SECTION 1
  2        On page 1 of the printed bill,  in  line  24,  delete  "flags  flown"  and
  3    insert: "flag flown over the capitol building".

                STATEMENT OF PURPOSE 
                      RS09863C1 
     
     Relating to the setting of the United States flag and the State flag of Idaho at
     half-staff to honor deaths in the line of duty for police, firefighters, paramedics,
     EMTs or reserve personnel who reside or work in the state of Idaho. 
     
     The greatest gift given to public safety is in the loss of ones life in protecting or
     assisting others. This high tribute by the state of Idaho reflects the thank you from
     the public. The procedures and protocol are set forth in the proposed legislation.
