to any juror, arbitrator, umpire or referee for his verdict or decision
after the verdict or decision has been rendered; and to prohibit any juror,

  2    RELATING TO IMPROPER PAYMENTS  TO  JURORS  OR  ARBITRATORS;  AMENDING  SECTION
  3        18-1304,  IDAHO  CODE, TO PROHIBIT ANY PERSON FROM GIVING OR ATTEMPTING TO
  4        GIVE ANY PAYMENT OR REWARD TO ANY JUROR, ARBITRATOR,  UMPIRE  OR  REFEREE,
  5        NOT  OTHERWISE  AUTHORIZED  BY  LAW, FOR HIS VERDICT OR DECISION AFTER THE
  6        VERDICT OR DECISION HAS BEEN RENDERED AND TO MAKE  TECHNICAL  CORRECTIONS;
  7        AMENDING  SECTION  18-1305, IDAHO CODE, TO PROHIBIT ANY JUROR, ARBITRATOR,
  8        UMPIRE OR REFEREE FROM ASKING FOR OR RECEIVING ANY PAYMENT OR  REWARD  NOT
  9        AUTHORIZED  BY  LAW FOR HIS VERDICT OR DECISION AFTER THE VERDICT OR DECI-
 10        SION HAS BEEN RENDERED AND TO MAKE TECHNICAL CORRECTIONS; AND PROVIDING AN
 11        EFFECTIVE DATE.
                                                                        
 12    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 13        SECTION 1.  That Section 18-1304, Idaho Code, be, and the same  is  hereby
 14    amended to read as follows:
                                                                        
 15        18-1304.  ATTEMPT  TO INFLUENCE JURORS AND ARBITRATORS. (1) Any Every per-
 16    son who corruptly attempts to influence a juror, or  any  person  summoned  or
 17    drawn  as  a  juror, or chosen as an arbitrator or umpire, or appointed a ref-
 18    eree, in respect to his verdict in, or decision  of,  any  cause  pending,  or
 19    about to be brought before him, either:
 20        1.(a)  By  means  of  any  communication,  oral  or written, had with him,
 21        except in the regular course or proceedings;
 22        2.(b)  By means of any book, paper or instrument exhibited, otherwise than
 23        in the regular course of proceedings;
 24        3.(c)  By means of any threat, intimidation, persuasion or entreaty; or,
 25        4.(d)  By means of any promise or assurance  of  any  pecuniary  or  other
 26        advantage; is guilty of a felony.
 27        (2)  Any  person  who  gives  or  offers to give  any payment, gratuity or
 28    other reward, except as may be authorized by law, to any person for  his  ser-
 29    vice  as  a  juror,  arbitrator, umpire, or referee, or for his verdict in, or
 30    decision of, any cause after the verdict or  decision  has  been  rendered  is
 31    guilty of a misdemeanor.
                                                                        
 32        SECTION  2.  That  Section 18-1305, Idaho Code, be, and the same is hereby
 33    amended to read as follows:
                                                                        
 34        18-1305.  MISCONDUCT OF JURORS AND ARBITRATORS. (1)  Any  Every  juror  or
 35    person  drawn  or  summoned  as  a  juror,  or chosen arbitrator or umpire, or
 36    appointed referee, who either:
 37        1.(a)  Makes any promise or agreement to give a verdict or decision for or
 38        against any party; or,
 39        2.(b)  Wilfully Willfully and corruptly permits any  communication  to  be
 40        made to him, or receives any book, paper, instrument or information relat-
 41        ing  to  any  cause  or matter pending before him, except according to the

  1        regular course of proceedings, is guilty of a felony.
  2        (2)  Any juror, arbitrator, umpire, or referee, who asks for  or  receives
  3    any  payment,  gratuity  or other reward, or promise thereof, except as may be
  4    authorized by law, for service as such juror, arbitrator, umpire or referee or
  5    for his verdict in, or decision of, any cause after the  verdict  or  decision
  6    has been rendered, is guilty of a misdemeanor.
                                                                        
  7        SECTION  3.  This  act shall be in full force and effect on and after July
  8    1, 2000.

                STATEMENT OF PURPOSE

     The purpose of this legislation is to amend Section 18-1304, Idaho Code, to 
     prohibit any person from giving or attempting to give any payment or reward to
     any juror, arbitrator, umpire or referee, not otherwide authorized by law, for his
     verdict or decision after the verdict or decision has been rendered and to amend
     Section 18-1305, Idaho Code, to prohibit any juror, arbitrator, umpire or referee
     from asking for or receiving any payment or reward not authorized by law for his
     verdict or decision after the verdict or decision has been rendered.
