2 RELATING TO PUBLIC UTILITY AND TELECOMMUNICATIONS FEES; AMENDING CHAPTER 10,
3 TITLE 61, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 61-1010, IDAHO
4 CODE, TO PROVIDE FOR THE DIRECT RECOVERY OF FEES PAID BY TELEPHONE CORPO-
5 RATIONS THROUGH SURCHARGES PASSED ON TO CUSTOMERS.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Chapter 10, Title 61, Idaho Code, be, and the same is
8 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
9 ignated as Section 61-1010, Idaho Code, and to read as follows:
10 61-1010. RECOVERY OF FEES PAID BY TELEPHONE CORPORATIONS. Any telephone
11 corporation providing basic local exchange service within the state of Idaho
12 and any telephone corporation providing intrastate message telecommunications
13 service within the state of Idaho, including those otherwise exempt from the
14 jurisdiction of the commission pursuant to section 61-104, Idaho Code, and any
15 telephone corporation providing local exchange services or message telecommu-
16 nications services pursuant to the telecommunications act of 1988, chapter 6,
17 title 62, Idaho Code, shall be authorized to pass on to its customers, in the
18 form of a surcharge or surcharges on customer rates, the full amount it pays
19 in all fees payable to, collected or recovered by, or in any way associated
20 with the commission or its authority under any law of this state.

The purpose of this bill is to allow telephone
corporations to pass the charges paid to or
collected by the Idaho Public Utilities Commission
through to their customers. Currently, charges for
the Idaho telecommunications service assistance
program and the Universal Service Fund are separately
identified and charged on customers' bills. The
charges to fund the Public Utilities Commission
and telephone relay service, are not separately
identified, but are included in the customers' rates.
This bill would allow all such fees and charges to
be separately identified on the customer's bill.
